HomeMy WebLinkAboutResolutions 2011-118 N.C.S. 08/01/2011Resolution No. 2011-118 N.C.S. of the City of Petaluma, California APPROVING THE PROJECT BUDGET AND AUTHORIZING THE AWARD OF CONTRACT FOR THE CYCLE 8 SAFE ROUTES TO SCHOOLS PROJECT TO BAY PACIFIC PIPELINES, INC. WHEREAS, City staff has prepared construction bid documents and advertised for construction of this Project; and, WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and, WHEREAS, the Project was bid on July 13, 2011, and six (6) bids were received and opened in accordance with applicable law; and, WHEREAS, the lowest bid for the Project was from Bay Pacific Pipelines, Inc. for $377,344; and, WHEREAS, staff has determined that Bay Pacific Pipelines, Inc.'s bid satisfies the bidding requirements for the Project; and, WHEREAS, staff has verified that Bay Pacific Pipelines, Inc. possesses a valid California Contractor's License, Class A, number 524020 that qualifies Bay Pacific Pipelines, Inc. to perform the Project; and, WHEREAS, the Project is exempt pursuant to California Environmental Quality Act ("CEQA") pursuant to Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301, as the minor alteration of existing public facilities with negligible or no expansion in use. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City hereby: Approves the Project Budget in the amount of $590,541, including a construction contingency of $56,858. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non-conformance in the bid of Bay Pacific Pipelines, Inc. for the Cycle 8 Safe Routes to Schools Project, finds the bid of $377,344 to be the lowest, responsive bid and further finds that Bay Pacific Pipelines. Inc. is the lowest responsible bidder. Awards the contract for the Cycle 8 Safe Routes to Schools Project to Bay Pacific Pipelines, Inc., in the amount of $377,344, the amount of the lowest responsive bid, conditioned on Bay Pacific Pipelines, Inc. timely executing the project Resolution No. 2011-118 N.C.S. Page 1 contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to Bay Pacific Pipelines, Inc. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Bay Pacific Pipelines, Inc. of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Under the power and authority conferred upon this Council by the Charter of said City.
