HomeMy WebLinkAboutResolution 2023-080 N.C.S. 06/05/2023 DocuSign Envelope ID:527B540E-AC34-435E-B155-6851AB611960 Resolution No. 2023-080 N.C.S. of the City of Petaluma, California TO CONTINUE BUDGET APPROPRIATION ORDINANCES 2812, 2813, 2814, 2815, 2816,AND 2817 N.C.S UNTIL FISCAL YEAR 2023-24 BUDGET APPROPRIATION ORDINANCES ARE IN EFFECT WHEREAS, on June 6, 2022, City Council approved Ordinances 2812, 2813, 2814, 2815, 2816, and 2817 N.C.S.which approved all fund appropriations for the operation of the City of Petaluma from July 1,2022 to June 30, 2023; and WHEREAS, the appropriation resolutions and first reading and introduction of budget ordinances for fiscal year 2023/24 took place at the May 15, 2023 meeting and will be adopted upon second reading at this June 5, 2023 meeting; and WHEREAS, pursuant to California Government Code Section 36937ordinances go into effect 30 days from adoption; and WHEREAS, due to the timing of this year's budget action and the need to have appropriation authority on July 1"2023,for spending to occur and current operations to continue,a continuing resolution is needed to provide temporary authorization for spending to begin on the first day of the new fiscal year; and WHEREAS, Section 60 of the Petaluma Charter states that, "Before the annual appropriation ordinance has been passed, the council may make temporary appropriations for current department expenses, chargeable to the appropriations of the year when passed, to an amount sufficient to cover the necessary expenses of the various departments,until the annual appropriation is in force"; and WHEREAS, The proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that adopting a continuing resolution to extend the current budget appropriation ordinances does not meet CEQA's definition of a"project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that adopting a continuing resolution to extend the current budget appropriation ordinances does not meet CEQA's definition of a"project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. 3. Adopts this resolution which will be automatically terminated once the budget appropriation ordinances for Fiscal Year 2023-2024 take effect. Resolution No. 2023-080 N.C.S.
