WHEREAS QANTAS DEVELOPMENT CORPORATION
(Subdvider)
has requested permission to grade PARK :PLACE NO. 3
Subdivision prior to approval of the'finalmap for said subdi-
vision by the Ciity,�aiid,
WHEREAS, this_Councilhas determined that this request"
should be grantedon the condition that the Subdivider enter
into a written -agreement satisfactory to the City Attorney and.
the City Engine.er,.'qu4-r-ante,e"ng that grading will conform to
said plan's and profiles.;- and,
WHEREAS;, Subdivide states it is their- intention to enter,
into a Subdivision Agre,Omentupon approval of the final map for
same,
NOW, THEREFORE,, this Council finds, determines and resolves
as follows:.
1. The- gra
'-d" -proposed by Subdivider -is not, a permanent
improvement as that terms -is used in Section 2:0.36.010 of the
Petaluma Municipal bodb..
2. S ub di Vi de,r- zh.lal 1 give an agreement in writing guaran-
teeing compliance -with- all City codes and ordinances as well as
compliance with the,'requirements for.final,grading as determined.
by' the City Engineer.
3. Subdivider, sh"a1l. provide. a, cash deposit or a surety
bond in an amount, satisfactory to the City Manager, securing per-
foxma.n.co of said agreement.

4. Said .agreement shall provide specifically that any
and all liability ra-r sinq, out the°''work'' performed by the
Subdivider,whether"such liability ar s•e,s''from acts or copse-'
quences occurring on-site or off -,site 'shall be the sole
responsibi,lity,:'of ._the. Subdivider.
5. In no event shall work. -be -commenced on said grading
until an agreement is signed by Sub.divi der-, and the City of
Petaluma, and all conditions precedent ,to, s;a'id work are per-
formed.
6. The City Manager or Mayor is hereby authorized to execute
an agreement on behalf of this Council,,,as approved as to form
by the City Attor-ney.-
7. The .conditions required , by the ,Community . Development
and Planning Director shall be complied with, (Exhibit A) .
under the power and authority conferred upon': this Council by the Charter of said City.

Park P'l'ace Subdivision No;. 3Rough Grading Permit'
The Community Developmentand PTanni.ng Department -recommends that if the
City Council approves the request:,, for the rough"grading„ of Park Place.
Subdivision No. 3, the subdi'vi°der shall` comply w th' each and every one of
.. the following conditions:
1. The is.sua'nce of a,grading,,pe,rmi't for the. propos,ed>;site of the Park Place
Subdivision No. :3..does not dommit. the .Ci`ty of Petaluma to the approval
of the' Final Subdivis.i'o.h Map in, any` manner or foam;.
2. When all material,`„s-.h`ave.been ' removed Vie'soi.ls engi.nee'r shall submit an
amended soils. report as to the co,nd tion` of, the. natural-. soils remaining
and certify that, the� . s�i to i s ,-.prepared .,,for the;. completion of the rough
grading.
