AT 611 PETALiJMA BLVD. NORTIFI, AP NO.OQ6-091-34 WHEREAS, on August 24, 1993, the Planning Commission, following the conclusion of a duly noticed public hearing, granted approval of an amendment to the Petaluma Tire Source, Inc.'s Conditional Use Permit authorizing a relocation of employee parking, tire storage and loading zone areas at 611 Petaluma Boulevard North, AP No. 006-091-34; and 13 14 WHEREAS, an appeal of the Planning Commission decision was appropriately filed by six 15 residents of Kentucky Street on September 6, 1993, stating objection to any proposed 16 expansion, and relocation of any outdoor storage and parking; and 17 18 WHEREAS, the City Council. held a public meeting on October 25, 1993 to consider the 19 appeal and all reports, documentation and testimony submitted on the matter; 20 21 NOW, THEREFORE, BE IT RESOLVED that the City Council finds as follows: 22 23 Findings: 24 1. The Planning Commission acted appropriately in its decision of August 24, 1993. 25 26 2. The proposed amendment to the Conditional Use Permit will not prevent the 27 neighbors from the preservation and enjoyment of their property and will further 28 screen the business operations from the adjacent properties. 29 30 3. The proposed Conditional Use Permit Amendment, as conditioned, will conform to 31 the requirements and intent of the Petaluma Zoning Ordinance providing an 32 appropriately located and screened outdoor storage and loading area and adequate 33 on-site parking facilities. 34 35 4. The proposed Conditional Use Permit Amendment, as conditioned, will conform to 36 the requirements and intent, goals, and policies of the Petaluma General Plan which 37 encourages appropriately designed neighborhood-serving, commercial uses along 38 Petaluma Boulevard. 39 93-289 1 Res. The proposed Conditional Use Permit Amendment will not constitute a nuisance or 2 be detrimental to the public welfare of the community, as the amendment 3 specifically approved relocation of the tire storage area to a more appropriately 4 screened location directly adjacent to the work shop area and further from the more 5 sensitive residences. 6 7 6. This project is Categorically Exempt under CEQA Section 15301, Existing Facilities, g of the CEQA Guidelines. 9 10 BE IT FURTHER RESOLVED that the City Council hereby denies the appeal of the six 11 Kentucky Street residents, and sustains the Planning Commission's action to allow an 12 amendment to the Petaluma Tire Source's Conditional Use Permit, subject to the following 13 conditions: 14 15 Conditions: 16 1. All conditions of approval from the Planning Commission's 3/21/78 Conditional 17 Use Permit and Site Design review approval shall remain in full force and effect. 18 19 2. Exhibit A shall be approved as amended to show the approved parking, storage and 20 loading areas. 21 22 3. Hours of operation shall be limited to those posted at the Petaluma Tire Source; 23 Monday to Friday 8AM to SPM, Saturday 8AM to 2PM. 24 25 4. A landscape plan, landscape maintenance plan, and fencing plan shall be submitted 26 to the Planning Director for review and approval within 30 days of this approval and 27 landscaping shall be installed within 60 days of this approval around new parking 28 areas as shown on Exhibit A. 29 30 5. The property shall be kept cleared of all weeds and debris. 31 32 6. Spacing of aisles and height of tire stacks shall comply with the Uniform Fire Code. 33 34 7. Parking lot shall be striped to City Standards and abandoned vehicles removed 35 within 30 days of this approval., subject to review by Planning staff. 36 Reso. 93-289 NCS 2 1 2 3 4 5 6 7 8 8. This Conditional Use Permit shall be reviewed by the Planning Director within 6 months from the effective date of this amendment to determine compliance with the conditions of approval.
