HomeMy WebLinkAboutResolution 93-290 10/25/1993r Resoluti®n N®. 93-290 N ~.5. 1 of the City of Petaluma, California 2 3 RESOLUTION DENYING APPEAL OF JOHN AND SUE FOX, 4 UPHOLDING STAFF'S CONDITIONAL APPROVAL OF ONE 5 OUTSIDE SEWER CONNECTION FOR 112 PURRINGTON ROAD 6 7 WHEREAS, the City of Petaluma adopted Resolution #89-68, setting forth a policy 8 regarding sewer service outside the City limits; and, 9 10 WHEREAS, said policy provides for the conditional administrative approval of a request 11 for outside sewer connection for properties within the Urban Limit Line; and 12 13 WHEREAS, John and Sue Fox requested an outside sewer connection for property known 14 as 112 Purrington Road; and 1.5 16 WHEREAS, The Directors of Engineering and Planning did review the request and 17 conditionally approved said request; anal 18 19 WHEREAS, John and Sue Fox thereafter, in a timely manner, did appeal the conditional 20 approval, specifically Condition #3, requiring public road and utility improvements to 21 Purrington Road; and 22 23 WHEREAS, on October 25, 1993 the City Council considered the appeal and heard all 24 written and oral testimony regarding same. 25 26 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby denies the appeal 27 of John and Sue Fox, subject to the modified administrative conditions set forth below: 28 29 1. A City sewer hook-up fee, currently $2,550, for a principal dwelling, is due and 30 payable prior to hooking up to the City sewer. The fee is to be paid at the time of 31 issuance of a City plumbing permit for the connection to the main line. 32 33 2. An annexation impact fee, currently $1728.86 (Community Facilities $1488.86, 34 Park/Dwelling Construction $240) is due and payable prior to hook-up to the City 35 sewer. The fee is to be paid at the time of issuance of a City plumbing permit, as 36 noted in #1 above. 37 1 93-290 Res. No . .............................. N.C.S. 1 3. Street improvements (street, curb, gutter, sidewalk, water lines for domestic use and 2 fire protection, street lights and storm drainage facilities as deemed appropriate) 3 shall be designed concurrently with the sewer main. Said improvements and 4 required right-of-way dedication shall be constructed, and dedicated, as deemed 5 appropriate by City staff, along the subject parcel concurrently with the construction 6 of the sewer main extension (note: typical curb to curb section of a residential 7 collector street is 40', with aright-of-way of 50' + ). A payback agreement may be 8 requested to recover proportionate fair share of sewer main construction and public 9 improvement design, subject to approval by the City Council. 10 11 4. Pending Council action, a payback agreement may be in place for the extension of 12 the sewer main from Westridge Drive to "I" Street. If approved by Council, all 13 properties connecting to the "I" Street sewer will be subject to proportional 14 reimbursement as set forth in said Payback Agreement. 15 16 5. A County plumbing permit may be required. A County encroachment permit, to 17 work in County right-of-way, may also be required. You, your engineer, or your 18 contractor should check with the County Public Works Department. 19 20 6. Within 30 days after connection to City sewer, existing septic systems shall be 21 abandoned per the Uniform Building Code, subject to inspection and approval of 22 the County's Public Health Department. 23 24 7. Existing water pressure constraints limit fire protection flow; City fire protection 25 cannot be provided above 160' elevation. Additional capital improvements may be 26 deemed necessary to provide adequate fire flow for any structure above 160' 27 elevation at time of annexation. 28 29 resofox/pt8 Under the power and authority conferred upon this Council by the Charter of said City.
