HomeMy WebLinkAboutResolution 2023-155 N.C.S. 10/02/2023 DocuSign Envelope ID: F432D8CC-2826-443D-903A-5F6772A09DC4 Resolution No. 2023-155 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE PURCHASE OF A BACKHOE FOR THE PUBLIC WORKS & UTILITIES DEPARTMENT THROUGH SOURCEWELL COOPERATIVE PURCHASING PROGRAM AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS,the City of Petaluma seeks to purchase the replacement of the street division's backhoe; and WHEREAS, Section 4.04.050 of the Petaluma Municipal Code allows formal bidding procedures to be dispensed with when the commodity can be obtained from only one vendor; and WHEREAS, the City is a member of the Sourcewell Cooperative Purchasing Program (formerly National Joint Powers Alliance) which supports cooperative purchasing, allowing the City the opportunity to access competitively awarded and nationally leveraged cooperative purchasing contracts; and WHEREAS, the Sourcewell cooperative price meeting specifications for the backhoe was submitted by Sonsray Machinery, an approved vendor for CASE Construction (Sourcewell Contract #032119-CNH) for $151,958.17; and WHEREAS, the backhoe provided by CASE Construction is consistent with other(City-owned) equipment using the hardware, training, and methods of operation. Additionally, the equipment has better abilities and utilizes renewable diesel fuel; and WHEREAS, funds in the amount of$150,000 were included and approved in the FY 23/24 budget for the purchase of a backhoe. The budget allocated for the vehicle purchase is insufficient and will need to be increased by $2,000 using vehicle and equipment replacement funds; and WHEREAS, the proposed action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) as replacing a backhoe with one with a renewable diesel engine will reduce emissions from an equivalent internal combustion vehicle and CEQA Guidelines Section 15301 (Existing Facilities). NOW, THEREFORE, BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares that the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Find that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) Section 15061(b)(3) as replacing a backhoe with one with a renewable diesel engine will reduce emissions from an equivalent internal combustion vehicle and CEQA Guidelines Section 15301 (Existing Facilities). 3. Finds that purchasing the backhoe through Sourcewell Cooperative Purchasing Program is in compliance with the purchasing requirements of the City Charter and Chapter 4.04 of the Petaluma Municipal Code. Approves the purchase of one backhoe from CASE Construction through their approved vendor Sonsray Machinery for$151,958.17, including taxes and fees. 5. Authorizes the City Manager, or her designee, to execute any necessary agreements and documents to complete the purchase of the vehicles and related equipment. Under the power and authority conferred upon this Council by the Charter of said City.
