HomeMy WebLinkAboutResolution 2023-160 N.C.S. 10/16/2023 DocuSign Envelope ID:A4A2126B-5740-47A8-A07D-F87A60D370EA Resolution No. 2023-160 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE CITY MANAGER TO GRANT AN EASEMENT TO PACIFIC GAS & ELECTRIC COMPANY AT 555 N. MCDOWELL BLVD. ALLOWING CONSTRUCTION,MAINTENANCE,AND ACCESS TO "TO THE METER" INFRASTRUCTURE NEEDED TO SUPPORT BATTERY-ELECTRIC BUS CHARGING INFRASTRUCTURE WHEREAS, the City of Petaluma provides transit service throughout the community using the Petaluma Transit vehicle fleet; and WHEREAS, the City of Petaluma seeks to convert its vehicle fleet to zero-emission vehicles as part of its goal to achieve carbon neutrality by 2030, as well as Federal Transit Administration and California Air Resource Board requirements; and WHEREAS, on September 11, 2023, the City Council approved Resolution No. 2023-136 N.C.S. adopting the Petaluma Transit Zero-Emission Fleet Transition Plan, which formalizes Petaluma Transit's framework for the transition from its existing internal combustion fleet to battery-electric, zero-emission buses, and paratransit vans; and WHEREAS, the transition to a zero-emission transit fleet by 2030 requires infrastructure upgrades at the City's transit facility at 555 N. McDowell Boulevard; and WHEREAS, in March 2023, the City of Petaluma entered into an agreement with Pacific Gas & Electric (PG&E) in which PG&E will upgrade the meter(TTM) infrastructure serving the City's transit facility at no cost to the City, and the City will design, build, own, operate, and maintain all behind the meter and charging infrastructure; and WHEREAS, PG&E determined it would need a standard utility easement allowing it to construct, access, and maintain PG&E-owned TTM infrastructure,which would be located near the northeastern corner of the City's property at 555 N. McDowell Blvd., APN 007-391-039). NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15301 (existing facilities) and Section 15303 (new construction),as the eventual installation of TTM and BTM infrastructure will be made to an existing facility. Class 1 changes are exempt and consist of the operation,repair,maintenance,permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use. Class 3 consists of construction and location of limited numbers of new structures, and installation of small equipment, Electrical infrastructure and improvements that convey negligible or no development of service are covered under these exemptions. Authorizes the City Manager, or their designee, to grant an easement to Pacific Gas & Electric Company at 555 N. McDowell Blvd. so they are allowed Construction, Maintenance, and Access to "to the meter" infrastructure to support battery-electric bus charging infrastructure. Under the power and authority conferred upon this Council by the Charter of said City.
