HomeMy WebLinkAboutResolution 2023-165 N.C.S. 10/16/2023 DocuSign Envelope ID:A4A2126B-5740-47A8-A07D-F87A60D370EA Resolution No. 2023-165 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA DECLARING A VACANCY OF THE PLANNING COMMISSION AND APPOINTING JESSICA MOZES TO FILL SUCH VACANCY FOR THE UNEXPIRED TERM, PURSUANT TO PETALUMA MUNICIPAL CODE SECTION 2.08.040 WHEREAS, Section 2.08.040 of the Petaluma Municipal Code, titled "Vacancies," outlines the process by which the City Council is to handle the appointment of a new member to the Petaluma Planning Commission in the event of a vacancy; and WHEREAS, Section 2.08.040 of the Petaluma Municipal Code states that, "Upon the death, resignation, disability to perform the duties of a member of the planning commission, or upon the loss of permanent residency from the city,or upon the failure to attend any meetings of the commission for three consecutive regular meetings, the council shall review, and if found to be appropriate, declare the office of such member vacant and thereupon appoint some qualified person to fill such vacancy for the unexpired term of such member;" and WHEREAS, the Planning Commission currently has a vacancy due to the passing away of one of its members. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act(CEQA) in accordance with CEQA Guidelines Section 15378(b)(4), in that, declaring a vacancy and a new appointment to the Planning Commission does not meet CEQA's definition of a"project," because the action does not have the potential for resulting either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because this is a personnel-related action that constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. 3. Declares that there is a vacancy on the Petaluma Planning Commission. 4. Finds that Jessica Mozes is qualified to be a member of the Petaluma Planning Commission and is appointed to the Petaluma Planning Commission to fill the unexpired term of the vacancy.
