HomeMy WebLinkAboutResolution 2023-183 N.C.S. 12/18/2023 DocuSign Envelope ID: 1CF6ECO2-87F4-4494-B893-633AOA19EDCO Resolution No. 2023-183 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA ACCEPTING BIDS AND AWARDING CONTRACTS TO THE LOWEST RESPONSIBLE BIDDERS FOR FURNISHING CHEMICALS FOR WASTEWATER TREATMENT FOR FISCAL YEAR 21/22 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY AGREEMENTS OR PURCHASE ORDERS WHEREAS, the City of Petaluma has multiple facilities that house fueling services infrastructure for Petaluma's fleet; and WHEREAS, the City of Petaluma has a need for an updated fueling services contract for fuel delivered to these facilities; and WHEREAS,the City of Petaluma entered into a Memorandum of Understanding with the City of Santa Rosa and the County of Sonoma for a joint fueling services Request for Proposals; and WHEREAS,the lowest responsive bidders for the fueling services contract was Ramos Oil; and WHEREAS, the purchasing of fuel is necessary for City of Petaluma operations this action is categorically exempt from further review of the California Environmental Quality Act (CEQA) pursuant to Guidelines Section 15301 (Existing Facilities) which exempts the operation, repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment or topographic features involving negligible or no expansion of use beyond that previously existing and the purchasing of chemicals to treat wastewater is exempt pursuant to CEQA Guidelines Section 15307 (Actions by a regulatory agency for protection of natural resources) and there are no cumulative impacts, unusual circumstances or other factors that would make these exemptions inapplicable pursuant to CEQA Guidelines section 15300.2. NOW,THEREFORE, BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the purchasing of fuel necessary for continued City of Petaluma operations is categorically exempt from further review of the California Environmental Quality Act (CEQA)pursuant to Guidelines Section 15301 (Existing Facilities) which exempts the operation, repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment or topographic features involving negligible or no expansion of use beyond that previously existing and the purchasing of chemicals to treat wastewater is exempt pursuant to CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption) as switching to renewable diesel is better for the environment than regular diesel and there are no cumulative impacts, unusual circumstances or other factors that would make these exemptions inapplicable pursuant to CEQA Guidelines section 15300.2. 3. Finds that the purchase of fuel satisfies the City's purchasing requirements. 4. Authorizes the City Manager to award bids and execute all necessary documents for the purchase of Unleaded Mid-Grade 87 Octane and Renewable Diesel RD80-RD 100 from Ramos Oil.
