HomeMy WebLinkAboutResolution 2023-189 N.C.S. 12/18/2023 DocuSign Envelope ID: 1CF6ECO2-87F4-4494-B893-633AOA19EDCO Resolution No. 2023-189 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE PURCHASE OF ONE POLICE FORD INTERCEPTOR FOR THE AMOUNT OF$60,000, ONE 2024 POLICE HARLEY DAVIDSON MOTORCYCLE FOR THE AMOUNT OF $39,585.79,AND AN ESTIMATED $25,000 FOR THE PURCHASE OF STANDARD ACCESSORY EQUIPMENT AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS,the Police Department was awarded $425,000 for the 2023/2024 Office of Traffic Safety Grant, which includes $40,000 to replace one police motorcycle and $85,000 to replace one police DUI patrol vehicle; and WHEREAS,using the funds awarded by the grant, the proposed action will allow the Department to replace the two traffic vehicles with newer and more efficient vehicles; and WHEREAS, using the grant funds, the proposed action will allow the Department to procure two police vehicles to be used in our traffic operations and emergency response to increase overall traffic safety; and WHEREAS,the overall aim is to replace older model vehicles with newer more efficient models to help with greenhouse gases and carbon emissions reductions consistent with our Climate Ready 2030 goals and initiatives; and WHEREAS,the Police Department currently has a traffic fleet comprising of eight motorcycles and one 2016 Police Ford Interceptor for DUI enforcement; and WHEREAS,the Department recognized the need to replace a current Police Motorcycle and the current DUI Police Ford Interceptor due to mileage and years of service; and WHEREAS, the Department has taken steps to evaluate opportunities to identify available alternative fuel source vehicles to meet operational needs while meeting our climate goals; and WHEREAS, there are no factory produced all-electric police motorcycles on the market specifically manufactured for police operations; and WHEREAS, the only gas-powered motorcycles that come with complete factory-installed police packages such as the Harley Davidson package that the Department has historically utilized in our Traffic Operations; and WHEREAS, the primary rationale behind this decision lies in the broader availability of police-specific equipment designed for gasoline motorcycles, ranging from pursuit-rated engines to specialized lighting and communication systems; and WHEREAS, electric motorcycles offer environmental benefits, their limited range and the availability of dedicated police equipment is a significant challenge; and WHEREAS, the safety of our officers during high-speed pursuits and emergency responses remains paramount; and WHEREAS, the Department continues to evaluate options to transition gasoline-powered vehicles into Resolution No.2023-189 N.C.S. Page 1 DocuSign Envelope ID: 1CF6ECO2-87F4-4494-B893-633AOA19EDCO electric vehicle options and the Department is planning to pilot the all-electric Chevrolet Blazer Police patrol vehicle when available, and WHEREAS, hybrid vehicles offer a compromise by providing improved fuel efficiency and reduced emissions while maintaining the flexibility of traditional gasoline engines until other options become available; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that purchasing of these vehicles do not meet CEQA's definition of a "project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment; and WHEREAS, if the purchases did constitute a"project"under CEQA, this item would be exempt pursuant to CEQA Guidelines Section 15061 (the Common Sense exemption) as the replacement of existing vehicles with more fuel efficient vehicles will not cause a significant effect on the environment; and WHEREAS, the common law recognizes a bidding exception for circumstances where competitive bidding of public contracts otherwise required by statute may be excused, including circumstances where the contract is such that competitive proposals would be unavailing or would not produce an advantage, and the advertisement for competitive bid would thus be undesirable, impractical, or impossible (Graydon v. Pasadena Redevelopment, Agency (1980) 104 CA3d 631) and our purchasing ordinance, Chapter 4.04 of the Petaluma Municipal Code exempts bidding purchases that are only offered by one source; and WHEREAS, bidding for the vehicles is not advantageous to the City due the Officer of Traffic Safety grant which requires use of the funds by a specific deadline and with the limited amount of vehicles that meet the Departments safety specifications it is not believed that a vehicle would be available when the City bids the items. Moreover, the Department believes there is a need to replace an existing DUI vehicle and motorcycle due to mileage and years in service and is near the end of its useful life and there is a public safety concern for expediting these purchases; and WHEREAS, for the purchase of these vehicles the bidding this project is not advantageous to the City due to the Police Department being awarded $425,000 for the 2023/2024 Office of Traffic Safety Grant,which includes $40,000 to replace one police motorcycle and$85,000 to replace one police DUI patrol vehicle with upfit. NOW,THEREFORE,BE IT RESOLVED,that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that purchasing of these vehicles do not meet CEQA's definition of a"project,"because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. Additionally,if the purchases did constitute a"project"under CEQA, this item would be exempt pursuant to CEQA Guidelines Section 15061 (the Common Sense exemption) as the replacement of existing vehicles with more fuel efficient vehicles will not cause a significant effect on the environment. Finds that these purchases satisfied the City's purchasing requirement under both the sole source exception and the Gradyon case law. 4. Authorizes the City Manager, or her designee, to execute any necessary agreements and documents for the Police Department to purchase one (1) Police Ford Interceptor and one (1) 2024 Police Harley Davidson Motorcycle. Under the power and authority conferred upon this Council by the Charter of said City.
