HomeMy WebLinkAboutResolution 92-012 01/21/1992Resolution No. 92-12 N.C.s. 1 of the City of Petaluma, California 2 APPR®VING F®LTRTH EXTENSION ®F 1989 ALLOTMENTS 3 FOR TWIN CREEKS SiTBDIVISION 4 5 WHEREAS, the City of Petaluma has adopted a Residential Growth Management System 6 Ordinance; and 7 8 WHEREAS, Twin Creeks Subdivision was granted 65 - 1989 allotments pursuant to the 9 Residential Growth Management System Ordinance on June 20th, 1988 at a public 10 meeting by the City Council; and 11 12 WHEREAS, Section 17.26.070(F) of the Residential Growth Management System 13 Ordinance (Chapter 17.26 of the Municipal Code) establishes a deadline of December 31st 14 of the year said allotments are granted for, as the date by which certain projects must have 15 either an approved tentative map or have been through preliminary review and have had 16 their project application deemed complete by the Community Development Department; 17 and 18 19 WHEREAS, Section 17.26.070(G) of the Residential Growth Management System 20 Ordinance requires projects subject to the growth management system to have completed 21 approval of all related documents on or before December 31st of the year for which the 22 allotments have been granted or said allotments shall be forfeited; and 23 24 WHEREAS, with appropriate findings the City Council may extend the December 31st 25 deadline for projects approval and forfeiture of allotments; and 26 27 WHEREAS, failing to meet the deadline of December 31, 1989, to have a completed, 28 approved project, Twin Creeks 1989 allotments became subject to forfeiture, pursuant to 29 the Residential Growth Management System; and 30 31 WHEREAS, on December 11, 1989, the Council extended all 65 - 1989 allotments granted 32 to Twin Creeks to June 30, 1990; and on June 18, 1990 extended 50 allotments to 33 December 31, 1990; and 34 35 WHEREAS, on June 4, 1990, the City Council certified the Environmental Impact Report 36 for Twin Creeks, but denied the project due to being inconsistent with the General Plan, 37 substantial environmental impacts identified by the EIR and flooding problems identified 38 by the Army Corps of Engineers; and it~~. N~.......92-.12......... n.cs. . ~~ 1 2 WHEREAS, the applicant submitted a revised project in August of 1990 and it was 3 determined that a Supplemental Environmental Impact Report (SEIR) was necessary to 4 address the impacts of the revised project; and 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 WHEREAS, the tentative map submitted utilized only 43 of the 50 allotments granted; and WHEREAS, the City Council extended 43 of the 1989 allotments until December 31, 1991; WHEREAS, the project was deemed complete in February of 1991; and WHEREAS, attempts to coordinate with the Army Corp of Engineers flood control project and several critical comments received on the SEIR after the close of the public comment period have delayed the processing of the SEIR and tentative map; and WHEREAS, the FSEIR has been completed and reviewed by the Planning Commission and is scheduled to be acted upon by the City Council at the January 21, 1992 meeting; and NOW, THEREFORE BE IT RESOLVED that the City Council hereby extends the forfeiture deadline of December 31, 1991 to February 29, 19.92 for 43 1989 allotments 21 granted to Twin Creeks based on the following finding: 22 1. Attempts to coordinate with the Army Corps flood control project and. the receipt of 23 several important comments late in the comment period and after the close of the 24 comment period have delayed the processing of the SEIR and held up action by the 25 City Council on the Tentative Map application for the Twin Creeks Subdivision. 26 27 twincrks /council?
