HomeMy WebLinkAboutRESOLUTION 2024-006 N.C.S. 01/22/2024 DocuSign Envelope ID:66766FDF-4404-4685-9549-CEDF85614766 Resolution No. 2024-006 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE PURCHASE OF FOUR BATTERY ELECTRIC BUSES FROM NEW FLYER INDUSTRIES AND AUTHORIZING STAFF TO EXECUTE ALL NECESSARY DOCUMENTATION TO COMPLETE THE PURCHASE WHEREAS,the City of Petaluma seeks to provide effective transit service to the Petaluma Community; and WHEREAS, the City of Petaluma owns and operates a transit fleet of various transit vehicle types and sizes for its operations; and WHEREAS, the City of Petaluma seeks to replace four existing fixed-route buses that have reached the end of their operational lifespan with new units, in order to maintain fleet reliability; and WHEREAS,the City of Petaluma seeks to electrify its transit fleet in order to operate zero-emission vehicles in helping to fulfill the Petaluma Climate Action Emergency Framework; and WHEREAS, the City seeks to purchase four battery electric buses from New Flyer Industries (New Flyer) via the California Department of General Services (DGS) Contract#1-19-2317B; and WHEREAS, New Flyer provided pricing of $4,696,835 through the DGS contract with a total estimated project cost of$4,841,835, including all associated project costs; and WHEREAS, staff has determined that New Flyer is a qualified vendor and qualified to fulfill the bus order; and WHEREAS,the City currently has available funding in the amount of$4,696,835 to fund the project through a combination of funds for the project within the FY 24 budget. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares that the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council 2. The proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15061(b)(3) (the Commonsense Exemption),because it can be seen with certainty that there is no possibility that the purchase of electric buses to replace internal combustion engines would significantly impact the environment.Additionally,this action is categorically exempt pursuant to CEQA Section 15301 (Existing Facilities)as the purchases are to replace existing buses and will not expand the current use. 3. Finds that purchasing the buses through the DGS contract is in compliance with the purchasing requirements of the City Charter and Chapter 4.04 of the Petaluma Municipal Code. 4. Approves the purchase of four battery electric buses from New Flyer via the DGS contract for $4,696,835, including taxes. Resolution No. 2024-006 N.C.S. Complete required tasks associated with the bus purchase, including procuring bus build inspection services and bus graphic wrapping services. 6. Authorizes the City Manager or their designee to execute all documentation related to the bus purchase agreement with New Flyer. Under the power and authority conferred upon this Council by the Charter of said City.
