HomeMy WebLinkAboutRESOLUTION 2024-007 N.C.S. 01/22/2024 DocuSign Envelope ID:66766FDF-4404-4685-9549-CEDF85614766 Resolution No. 2024-007 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE PURCHASE OF CHARGEPOINT EXPRESS PLUS BATTERY-ELECTRIC BUS CHARGING EQUIPMENT THROUGH SOURCEWELL COOPERATIVE PURCHASING PROGRAM AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS, the City of Petaluma provides transit service throughout the community using the Petaluma Transit vehicle fleet; and WHEREAS, the City of Petaluma seeks to convert its vehicle fleet to zero-emission vehicles as part of its goal to achieve carbon neutrality by 2030, as well as Federal Transit Administration and California Air Resource Board requirements; and WHEREAS, on September 11, 2023, the City Council approved Resolution No. 2023-136 N.C.S. adopting the Petaluma Transit Zero-Emission Fleet Transition Plan, which formalizes Petaluma Transit's framework for the transition from its existing internal combustion fleet to battery-electric, zero-emission buses, and paratransit vans; and WHEREAS, the transition to a zero-emission transit fleet by 2030 requires infrastructure upgrades at the City's transit facility at 555 N. McDowell Boulevard; and WHEREAS, in March 2023, the City of Petaluma entered into an agreement with Pacific Gas & Electric (PG&E) in which PG&E will upgrade to-the-meter infrastructure serving the City's transit facility at no cost to the City, and the City will design, build, own, operate, and maintain all behind-the-meter and charging infrastructure; and WHEREAS,battery-electric bus charging equipment is needed to power battery-electric bus chargers; and WHEREAS, Section 4.04.050 of the Petaluma Municipal Code allows formal bidding procedures to be dispensed with when the commodity can be obtained from only one vendor; and WHEREAS, the City is a member of the Sourcewell Cooperative Purchasing Program, which supports cooperative purchasing, allowing the City the opportunity to access competitively awarded and nationally leveraged cooperative purchasing contracts; and WHEREAS,the Sourcewell cooperative purchase price for battery-electric bus charging equipment meeting City and PG&E specifications was submitted by Contractors Electrical Distributors, an approved vendor for ChargePoint(Sourcewell Contract#:042221-CPI) for$876,185.31, including tax and shipping; and WHEREAS, sufficient funds were included in the Transit Facility Electrification project's adopted FY 23/24 budget for this purchase, including $420,000 in charger rebates from PG&E. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Approves the purchase of battery-electric bus charging equipment manufactured by ChargePoint from Contractors Electrical Distributors in the amount of$876,185.31. Finds that the purchase complied with the City's purchasing requirements. 3. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15303 (New Construction). Section 15303 consists of construction of new, small facilities or structures and the installation of small new equipment and facilities in small structures and explicitly includes accessory structures. Here, the batteries would be installed within an existing facility are small and would be considered an accessory structure. Additionally, the purchase and installation are exempt pursuant to CEQA Section 15301, as the purchase and installation of charging equipment would be made to an existing facility. CEQA Class 1 modifications changes are exemptions and consist of the operation, repair, maintenance,permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use. Here, the electrical infrastructure and improvements would be minor, and an existing facility that conveys negligible or no expansion of use is covered under this exemption. 4. Authorizes the City Manager, or their designee, to execute any necessary agreements and documents to complete the purchase of charging equipment from Contractors Electrical Distributors via the Sourcewell Program. Under the power and authority conferred upon this Council by the Charter of said City.
