HomeMy WebLinkAboutRESOLUTION 2024-008 N.C.S. 01/22/2024 DocuSign Envelope ID:66766FDF-4404-4685-9549-CEDF85614766 Resolution No. 2024-008 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA TO CONSENT TO THE APPOINTMENT OF JESSIE GOOCH,DIRECTOR OF FINANCE, TO THE POSITION OF CITY TREASURER,ASSESSOR,AND TAX AND LICENSE COLLECTOR AND DELEGATING INVESTMENT AUTHORITY TO THE CITY TREASURER FOR FISCAL YEAR 2023-2024 WHEREAS, City Charter Section 24 gives the City Manager the power to appoint the City Treasurer, Assessor, and Tax and License Collector subject to the consent and approval of City Council by resolution; and WHEREAS,Jessie Gooch was hired as the City's Director of Finance on October 30, 2023; and WHEREAS, the City's Director of Finance traditionally holds the appointed position of City Treasurer, Assessor, and Tax and License Collector; and WHEREAS, the City Treasurer has the responsibility to invest the pooled idle cash from all City funds pursuant to California Government Code Sections 53601 and 53635; and WHEREAS, pursuant to the Government Code and the City's Statement of Investment Policy, the City Council must delegate authority to invest or reinvest funds, or to sell or exchange securities so purchased; and WHEREAS, on June 5, 2023, the Council delegated investment authority to the City Treasurer at that time (Corey Garberolio) for fiscal year 2023-2024; and WHEREAS, section 7910 of the Government Code requires cities to adopt a resolution setting the annual appropriations limit at a regularly scheduled meeting or a noticed special meeting; and WHEREAS, this action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, as appointing the City Treasurer does not meet CEQA's definition of a "project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, it is a fiscal activity which does not involve commitment to any specific project, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Finds the foregoing recitals true and correct and are incorporated herein. 2. Finds that this action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, as adopting the appropriations limit does not meet CEQA's definition of a"project,"because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, it is a fiscal activity which does not involve commitment to any specific project, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. Approves the appointment of Jessie Gooch, Director of Finance, to City Treasurer, Assessor, and Tax and License Collector as recommended by the City Manager. 4. Delegates investment authority to the City Treasurer for Fiscal Year 2023-2024. Under the power and authority conferred upon this Council by the Charter of said City.
