HomeMy WebLinkAboutResolution 92-097 04/20/1992FZesolution No. 92-97 N ~.5. 1 of the City of Petaluma, California 2 3 DENYING 1993 ALLOCATIONS 4 5 WHEREAS, the City Council has adopted a growth management system by Ordinance 6 1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure 7 for granting or denying allocations on a yearly basis; and 8 9 WHEREAS, interested developers have filed Notice of Intent to Develop forms in 10 accordance with the provisions of Chapter 17.26 and these, in combination with other 11 allocation obligations created and anticipated by the action of the City Council, comprise 12 the total number of allocation requests for 1993; and 13 14 WHEREAS, the City Council finds the award and/or denial of allocations is not a project 15 pursuant to Section 1578 of California Environmental Quality Act and, therefore, no 16 environmental action is necessary at this time. 17 18 NOW, THEREFORE, BE IT RESOLVED that the City Council denies 1993 allocations 19 to the Duffel Financial and Construction Company, who requested at least 100 allocations 20 fora 408 unit apartment complex on a 36.91 acre parcel located at the southwesterly corner 21 of Ely Boulevard South and Frates Road (APN 017-150-19). 22 23 BE IT FURTHER RESOLVED that the City Council makes the following findings in 24 support of its denial of 1993 allocations: 25 26 Findings: 27 1. The General Plan Land Use Map designates the subject site as "Specific Plan" with 28 a portion in "Urban Separator"; no other land use has been specified in anticipation 29 of preparation of a specific plan. Therefore, granting allocations to this site would 30 be inconsistent with these prudent pre-planning principles of the General Plan. 31 32 2. Only after a specific plan is prepared to determine the most appropriate use of this 33 site and only if the most appropriate use of the site is determined to be residential 34 should allocations be granted for this parcel in order to avoid prejudicing the 35 specific plan process.. 36 Rcs. There are more appropriate sites for high density dwellings at this time; l.e., sites 2 that are closer to existing shopping and other commodities, without a propensity to 3 cause urban sprawl, and within more developed areas so as to be more visually 4 compatible with its surroundings. 5 6 4. This project, being noncontiguous to any other existing or proposed development, 7 and adjacent to the Urban Limit Line, does not promote in-fill development or 8 preservation of existing open space around the City, which are legislative intents of 9 the Residential Growth Management System and goals of the General Plan, 10 11 12 5 13 14 15 16 respectively.
