HomeMy WebLinkAboutRESOLUTION 2024-043 N.C.S. 05/06/2024 DocuSign Envelope ID: E8C60FC4-F7DD-480B-BA56-2A8B2159823D Resolution No. 2024-043 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA ACCEPTING COMPLETION OF THE MANOR LANE TANK REHABILITATION PROJECT BY UNIFIED FIELD SERVICES CORPORATION WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Manor Tank Rehabilitation project("Project"); and WHEREAS, bids for the Project were opened on February 24, 2022, in accordance with California Public Contract Code Section 4104.5 and other applicable laws; and WHEREAS, Unified Field Services Corporation submitted the lowest responsible bid for the project for $1,600,205; and WHEREAS, by Resolution No 2022-048 N.C.S. adopted April 4, 2022, the City Council of the City of Petaluma found the bid of$1,600,205 for the Project to be the lowest responsive bid and awarded the Project to Unified Field Services Corporation in the amount of $1,600,205 conditioned on Unified Field Services Corporation's timely executing the Project contract and submitting all required documents and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any change orders and other amendments to the Project contract that is necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City so long as such change orders or amendments do not result in an increase in excess of agreement on behalf of the City; and WHEREAS,the following change orders(CCO)for the replacement of 120 rafter ties within the tank interior, cutting I beam rafters ends that obstructed the blasting and coating of the tank interior, and installation of a new complete internal cathodic protection (CP) system, reimbursement to the City for special inspection provided during rework to recoat the tank floor, and deduction of Bid Item 7 from the total contract amount affecting the project amount have been approved: Cost Change Order#1 $ 50,125.20 Change Order#2 $ 9,511.22 Change Order#3 $ 19,713.75 Change Order#4 $ 19,362.74 Total Change Orders $ 59,987.43; and WHEREAS, the final contract amount, as amended, including all change orders, overruns, and underruns, is $1,660,192.43 and is within the approved project budget; and WHEREAS, environmental compliance was already analyzed by the April 4,2022,Resolution Awarding the Construction Contract, when the City Council found that the Manor Lane Tank Rehabilitation Project was categorically exempt pursuant to the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project consisted of repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use. The improvements repaired and provided structural reinforcement of an existing City-owned reservoir without changing the use of those facilities. Accordingly, there was negligible or Resolution No. 2024-043 N.C.S. Page 1 DocuSign Envelope ID: E8C60FC4-F7DD-480B-BA56-2A8B2159823D no expansion of use beyond what currently exists and there were no cumulative impacts,unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines Section 15300.2; and WHEREAS, City staff have inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS,based on the foregoing, staff recommends acceptance of the Project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. The contract entitled Manor Lane Tank Rehabilitation Project (C67501007), with the final contract amount of $1,660,192.43, is accepted as complete, subject to the contractor's continuing warranty and other obligations pursuant to the contract. 3. Environmental compliance was already analyzed with Resolution Awarding the Construction Contract, on April 4, 2022, when the City Council found that the Manor Lane Tank Rehabilitation Project was categorically exempt pursuant to the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project consisted of repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 5. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty(60) days of the date of this Resolution and in accordance with the terms of the Project contract, the Petaluma City Charter, California Public Contract Code Section 7107, and applicable law.
