HomeMy WebLinkAboutRESOLUTION 2024-044 N.C.S. 05/06/2024 DocuSign Envelope ID: E8C60FC4-F7DD-480B-BA56-2A8B2159823D Resolution No. 2024-044 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING PURCHASE OF CARNIVAL DUAL WASTE RECEPTACLES FROM SPRUCE AND GANDER FOR PUBLIC DOWNTOWN LOCATIONS WHEREAS,on January 24,2022 the City Council authorized staff to apply for a CalRecycle grant to improve public waste receptacles in Petaluma; and WHEREAS,staff submitted an application for and on September 21,2023,CalRecycle notified staff of award of the Beverage Container Grant Program funding in the amount of$275,000; and WHEREAS, on April 11, 2023 staff preemptively sought feedback from the Historical and Cultural Preservation Committee regarding preferred designs for outdoor waste receptacles; and WHEREAS, in fall 2023 staff solicited community feedback on three designs for waste receptacles and received 956 responses;the top response was for the Expedition waste receptacle by Anova,however,Anova was unable to configure the receptacle to the City's specifications; and WHEREAS, the second highest vote receiver was the Carnival Dual Waste receptacle from Spruce and Gander(sole California distributor for the manufacturer, Thomas Steele); and WHEREAS, a quote received from Spruce and Gander for 30 trash/recycling waste receptacles totaled $95,017.00; and WHEREAS, CalRecycle funding is available in the amount of$75,000 and Zero Waste Sonoma funding is available in the amount of$20,017; and WHEREAS, the proposed action is exempt under the common-sense exemption, California Environmental Quality Act(CEQA) Guidelines Section 15061(b)(3), as the purchase of public trash and recycling receptacles to replace existing trash receptacles will facilitate waste reduction; and WHEREAS,the project is also categorically exempt pursuant to CEQA Guidelines Section 15301 (Existing Facilities) and Section 15304 (Minor Alterations to Land) as any impacts related to installation of the receptacles will be temporary. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma as follows: 1. The recitals set forth above are true and correct and incorporated into this resolution as findings for the Petaluma City Council. Resolution No. 2024-044 N.C.S. Authorization to purchase 30 Carnival Dual Waste receptacles is exempt under the common-sense exemption, California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3), as the purchase of public trash and recycling receptacles to replace existing trash receptacles will facilitate waste reduction. Additionally, receptacles installed would replace existing equipment therefore the project is also exempt pursuant to CEQA Guidelines Section 15301 (Existing Facilities). Installation work would be categorically exempt pursuant to CEQA Guidelines Section 15304 (Minor Alterations to Land) as any impacts related to installation of the receptacles will be temporary. 3. Finds that the unique circumstances related to the community-selected design and sole availability of the produce from a single California distributor justify a sole source purchase and is additionally exempt from the City's purchasing requirements pursuant to Gradon v. Pasadena Redevelopment Agency(1980) 104 CA3d 631 and therefore the City's purchasing requirements were satisfied with this purchase. 4. The City Manager or her designee is hereby authorized to take all actions necessary to implement this Resolution. Under the power and authority conferred upon this Council by the Charter of said City.
