HomeMy WebLinkAboutRESOLUTION 2024-045 N.C.S. 05/06/2024 DocuSign Envelope ID: E8C60FC4-F7DD-480B-BA56-2A8B2159823D Resolution No. 2024-045 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA APPROVING AWARD OF THE CONSTRUCTION CONTRACT TO REBUILDING TOGETHER FOR 10 PISTACHE COURT, PETALUMA, CA,ASSESSOR PARCEL NUMBER 006-630-016-000 WHEREAS,the City purchased at a foreclosure hearing the single-family home located at 10 Pistache Court, Petaluma, CA, Assessor Parcel Number 006-630-016-000 (Property); and WHEREAS, the Property is currently in disrepair and vacant; and will be rehabilitated by Rebuilding Together Petaluma; and WHEREAS, once the rehabilitation work is completed, the City will transfer ownership of the land to the Housing Land Trust of the North Bay and sell the home to an income qualified household; and WHEREAS,the common law recognizes a bidding exception for circumstances where competitive bidding of public contracts otherwise required by statute may be excused, including circumstances where the contract is such that competitive proposals would be unavailing or would not produce an advantage, and the advertisement for competitive bid would thus be undesirable, impractical, or impossible (Graydon v. Pasadena Redevelopment, Agency(1980) 104 CAM 631); and it would be impractical and not advantageous to the City to spend the resources and time to bid out the rehabilitation project as the City and State are currently in a shelter crisis and the sooner the City can perform the rehabilitation, the sooner a new family can make beneficial use of the property; and WHEREAS, it's also not advantageous to the City as typically, the City's bidding process takes two months to complete and every day that the property sits vacant could result in the property deteriorating further, which will cost more money for the City to rehab and vacant properties may also lead to nuisance conditions for the neighborhood; and WHEREAS,the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15301 (Existing Facilities) which exempts "Interior alterations"and the"restoration or rehabilitation of deteriorated or damaged structures"and this action will award a contract to Rebuilding Together to complete the rehabilitation on the existing property. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares that the above recitals are true and correct and are incorporated herein as findings of this resolution. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15301 (Existing Facilities) which exempts "Interior alterations" and the "restoration or rehabilitation of deteriorated or damaged structures" and this action will award a contract to Rebuilding Together to complete the rehabilitation on the existing property. 3. Awards the contract for the rehabilitation of the single-family property located at 10 Pistache Court,Petaluma to Rebuilding Together, in the amount of$130,000, conditioned on Rebuilding Togethers timely execution the project contract, and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Finds that the City's purchasing requirements were satisfied under the common law, enumerated in Graydon v. Pasadena Redevelopment, Agency (1980) 104 CAM 631 as it would be impractical and not advantageous to the City to spend the resources and time to bid out the rehabilitation project. The City and State are currently in a shelter crisis and the sooner the City can perform the rehabilitation, the sooner a new family can make beneficial use of the property. Typically, the City's bidding process takes two months to complete and every day that the property sits vacant could result in the property deteriorating further,which will cost more money for the City to rehab. Vacant properties may also lead to nuisance conditions for the neighborhood. Additionally, the City has a current agreement with Rebuilding Together and is satisfied with their work.
