RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA APPROVING A ONE-YEAR
TIME EXTENSION OF THE VESTING TENTATIVE SUBDIVISION MAP FOR THE RIVERSCAPE
TOWNHOUSES PROJECT AS PART OF THE RIVERFRONT MIXED-USE DEVELOPMENT
LOCATED AT 500 HOPPER STREET,APN 136-690-007, FILE NO. PLET-2023-0005
WHEREAS, on June 29, 2021, applications were submitted to the City of Petaluma on behalf of Tim
Lewis TL Partners V L.P. for a Vesting Tentative Subdivision Map for the Riverscape Townhouse project (File
No. PLMA-21-0002) to subdivide the 3.68-acre property located at 500 Hopper St. (APN: 136-690-007) into 44
townhouse lots and 15 common open space parcels and related application for Site Plan and Architectural Review
(SPAR) for development of 44 townhomes with associated site improvements and including a request for
SmartCode Warrants ("the Project"); and
WHEREAS, on January 27, 2022, the applicant submitted revised plans for the Project to address
Planning Commission input by, among other changes, increasing the number of units from 44 to 50 consisting of
12 condominiums and 38 townhouses on 44 lots; and
WHEREAS, the City Council adopted Resolution Nos. 2014-125 N.C.S. and 2014-126 N.C.S. on July
14, 2014, certifying an Environmental Impact Report (EIR) and approving the Mitigation Monitoring and
Reporting Program (MMRP), respectively for the Riverfront Mixed-Use development (SCH# 2013062004)
including a townhouse component similar to the Riverscape Townhouse Project; and
WHEREAS, the Riverscape Townhome Project is substantially consistent with the certified Riverfront
Mixed-Use EIR and implements the townhome portion of the approved Riverfront project, and the minor increase
in the number of townhome units from that originally analyzed in the certified EIR was analyzed and found to
cause no substantial increase in the previously identified impacts or result in any new significant impacts. The
revised plan will not change the development footprint and, therefore, will not have a greater biological, cultural
resource, geological, hazardous materials, hydrological, or noise impacts than were evaluated in the EIR.
Furthermore, as detailed in the W-Trans analysis dated January 17,2022,the marginal increase in total daily trips
caused by the additional units will be offset by significant reductions in the total office uses in the Riverfront
Mixed-Use project or captured internally in the Riverfront site. Therefore,no further analysis under the California
Environmental Quality Act is required, and the relevant Mitigation Measures have been carried forward and
applied to the Riverscape project; and
WHEREAS, on March 7, 2022, the City Council adopted Resolution No. 2022-032 N.C.S., approving
the Riverscape Townhouse Vesting Tentative Subdivision Map for a 50-unit development consisting of 12
condominiums and 38 townhomes on 44 lots and 15 common open space parcels; and
WHEREAS, the approved Riverscape Vesting Tentative Subdivision Map is valid until March 7, 2024,
which is two years from the date of approval as allowed by Petaluma Municipal Code Section 20.21.010; and
WHEREAS, on October 25, 2023, Michael S. O'Hara, representing the property owner, applied for a
time extension of the Riverscape Vesting Tentative Map, pursuant to CA Government Code Section 66452.6(e);
and
WHEREAS, filing an extension request automatically extends the approved Riverscape Vesting

Tentative Subdivision Map 60 days from the date of approval(Government Code 66452.6.e.)while the extension
request is being considered by the City Council, thereby extending the expiration date of the Vesting Tentative
Subdivision Map until May 7, 2024; and
WHEREAS, Government Code Section 66452.6(e) provides that the local jurisdiction may extend
Tentative Subdivision Map approvals for up to six years; and
WHEREAS,the City Council has discretion to approve Vesting Tentative Subdivision Maps pursuant to
Petaluma Municipal Code Section 20.16.440 and,therefore,has discretion to approve time extensions of approved
Vesting Tentative Maps consistent with CA Government Code Section 66452.6(e); and
WHEREAS, the City Council considered the time extension request at a duly noticed public meeting on
April 15, 2024, and including the associated staff report; and
WHEREAS, the City Council found no new evidence indicating that the development of the project as
conditioned would place the residents of the subdivision or the community or both in a condition dangerous to
their health and safety to require additional or modified Vesting Tentative Subdivision Map conditions; and
WHEREAS,the City Council found no significant change to existing land use regulations for the project
site since the Vesting Tentative Subdivision Map was approved or to necessitate changes to the Vesting Tentative
Subdivision Map from those approved with the project; and
WHEREAS, appropriate environmental analysis was completed, and Resolution No. 2014-125 N.C.S.
was approved by the City Council certifying the Riverfront Environmental Impact Report for the overall
Riverfront Mixed-Use project, the Riverscape Townhome Project is substantially consistent with the certified
EIR and implements the townhome portion of the approved Riverfront project on Lot 7, and no changes are
proposed to the project from what was approved; therefore, no additional environmental review is required.
NOW THEREFORE, BE IT RESOLVED by the Petaluma City Council as follows:
1. Based on the above recitals, a one-year time extension for the Riverscape Townhouse Vesting Tentative
Subdivision Map is approved resulting in a new entitlement expiration date of March 7, 2025.
2. All findings, conditions, and mitigation measures of the original project approval, including those adopted by
Resolution Nos. 2014-125 N.C.S., 2014-126 N.C.S., and 2022-032 N.C.S. shall continue to apply to the
project.
