HomeMy WebLinkAboutRESOLUTION 2024-051 N.C.S. 05/20/2024 DocuSign Envelope ID:422D6DEE-11F6-4EB6-B192-14997571F117 Resolution No. 2024-051 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE AWARD OF CONTRACT FOR THE PAYRAN-MADISON AREA TRENCHING WATER AND SEWER MAIN REPLACEMENT PROJECT (C67502225, C66402245) TO COASTSIDE CONCRETE AND CONSTRUCTION, INC WHEREAS, City staff has prepared construction bid documents and advertised for construction of this Project; and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable laws, City staff solicited bids for the Project; and WHEREAS, the project was bid on March 22, 2024; and 8 (eight) bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was from Coastside Concrete and Construction, Inc. for $2,368,750; and WHEREAS, staff has determined that Coastside Concrete and Construction, Inc.'s bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Coastside Concrete and Construction, Inc. possesses a valid California Contractor's License, Class A, B, and C-8; number 995338, that qualifies Coastside Concrete and Construction to perform the project, and WHEREAS,the Payran-Madison Trenchless Sewer Main Replacement Project(C67502225, C66402245) is categorically exempt pursuant to the California Environmental Quality Act("CEQA")and Title 14,the California Code of Regulations ("CEQA" Guidelines"), Section 15301 because the project consists of repair and maintenance to existing public infrastructure and there is negligible or no expansion of use beyond what currently exists and there are no cumulative impacts,unusual circumstances,or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines Section 153100.2; and WHEREAS, a notice of exemption will be filed within 5 days of this resolution; and WHEREAS,the Public Works &Utilities Director has found this project to be substantially complex due to the number of tasks needed to complete the project,the number of resources and specialty contractor work needed to complete the project (including utility construction, number of days, workers, equipment and labor); the size and impact of the project (will require a partial lane closure on streets that impact traffic); the need for careful excavation of existing utilities to avoid damage to adjacent in street utilities. Therefore, this is a unique project that is not regularly performed and requires a higher retention amount than five percent, and WHEREAS, In accordance with Government Code Section 830.6, Gina Benedetti-Petnic has the authority and discretion to approve designs and has reviewed the designs and Reasonableness Memo and believes the designs to be reasonable based on: education, experience, and training that the designs meet current California State Water Resources Control Board standards,discussions,reviews and opinions of other engineers staffed with the City,based on the review of the site location and data regarding the site. Declares that the above recitals are true and correct and are incorporated into this Resolution as findings of the Petaluma City Council. 2. Finds that this Project is exempt pursuant to the California Environmental Quality Act("CEAQ")pursuant to Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301, as the minor alteration of existing public facilities with negligible or no expansion in use and there are no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines Section 15300.2. 3. In accordance with the City of Petaluma Charter and Municipal Code,California Public Contract Code Section 20162, and other applicable law, waives any and all non-conformance in the bid of Coastside Concrete and Construction, Inc., for the Payran-Madison Area Trenching Water and Sewer Main Replacement Project (C67502225, C66402245) and End the bid of$2,368,750 to be the lowest, responsive bid and further finds that Coastside Concrete and Construction, Inc., is the lowest responsible bidder. 4. Awards the contract for the Payran-Madison Area Trenching Water and Sewer Main Replacement Project (C67502225,.C66402245) to Coastside Concrete and Construction, Inc., in the amount of $2,368,750, the amount of the lowest responsible bid, conditioned on Coastside Concrete and Construction, Inc., timely executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 5. Directs staff to issue a notice of award to Coastside Concrete and Construction, Inc. 6. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Coastside Concrete and Construction of the signed project contract and all other required documents, including but not limited to executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 7. Approves a construction contract contingency of$765,000. Under the power and authority conferred upon this Council by the Charter of said City.
