OF ORDINANCE June 5, 2024 Introduced by: Brian Barnacle Seconded by: Janice Cader Thompson AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PETALUMA TO REDUCE ENFORCEABLE SPEED FROM 25 MPH TO 15 MPH WITHIN 500 FEET OF SCHOOL ZONES,AND FROM 25 MPH TO 20 MPH SPEEDS WITHIN THE BUSINESS ACTIVITY DISTRICT PURSUANT TO VEHICLE CODE SECTIONS 22358.4 AND 22358.9 WHEREAS, California Vehicle Code (CVC) Section 22358.9 permits local authorities to reduce the speed limits contiguous to a business activity district by five mph that meet specific conditions; and WHEREAS, the streets that are included in Attachment A of this Ordinance, which is incorporated into this Ordinance, meet the specific requirements of CVC Section 22358.9 and are eligible for the City to reduce its speed; and WHEREAS, California Vehicle Code Section 22358.4 permits local authorities to reduce the speed limits by five mph within 500 feet of school grounds for streets that meet specific conditions; and WHEREAS,the streets that are included in Attachment B of this Resolution, which is incorporated into this Ordinance, meet the specific requirements of CVC Section 22358.4 and are eligible for the City to reduce its speed; and WHEREAS, reducing speed limits encourages the use of alternative transportation modes such as public transit, biking, and walking. Safer and more inviting streets make non-motorized travel options more attractive, reducing traffic congestion and promoting a more sustainable urban lifestyle; and WHEREAS, reducing speed limits can enhance safety by reducing the severity of accidents, as reduced speeds decrease the likelihood of collisions and can mitigate the impact force, thereby reducing injuries and fatalities on the roads; and WHEREAS, lowering speed limits promotes a more pedestrian-friendly environment by creating safer conditions for walkers, joggers, and cyclists, as slower vehicle speeds increase reaction time and give vulnerable road users a better chance to avoid accidents; and WHEREAS,reducing speed limits can improve air quality and reduce pollution levels in urban areas as lower speeds lead to smoother traffic flow, which can decrease vehicle emissions, contributing to a healthier environment and reducing the carbon footprint of the City; and WHEREAS, lower speed limits can help mitigate noise pollution as slower-moving vehicles generate less noise,resulting in quieter neighborhoods and improved quality of life for residents living along busy streets; and Ordinance No. 2887 N.C.S. Page 1 DocuSign Envelope ID:422D6DEE-11F6-4EB6-B192-14997571F117 WHEREAS, Finds that the action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301I (Existing Facilities) as the removal and replacement of signs and minor speed reduction are a minor alteration to the City's existing streets and do not create additional automobile lanes and Section 15304 (Minor Alterations to Land) as the reduction in speed and new signs are a minor alteration to the existing streets and will not remove trees; and WHEREAS, this action is also exempt pursuant to CEQA Guidelines Section 15061 (Commonsense Exemption) as the reduction in speed will result in less greenhouse gas emissions from vehicles and may increase the amount of bicycle and pedestrian users; and WHEREAS, the City Council of the City of Petaluma held a duly noticed public meeting on April 8, 2024, at which time all interested parties were given full opportunity to be heard and to be present and City Council introduced the Ordinance. NOW THEREFORE BE IT ORDAINED by the City Council of the City of Petaluma, as follows: Section 1.Recital Findings.Declares the above recitals to be true and accurate and incorporated as findings herein of this Resolution. Section 2. Exemptions from CEQA. Finds that the action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301I (Existing Facilities) as the removal and replacement of signs and minor speed reduction are a minor alteration to the City's existing streets and do not create additional automobile lanes and Section 15304 (Minor Alterations to Land) as the reduction in speed and new signs are a minor alteration to the existing streets and will not remove trees. Section 3.CVC Section 22358.9 Findings.Finds pursuant to CVC Section 22358.9 that the portions of the streets proposed stated in Exhibit A have: 1. A maximum of four traffic lanes. 2. A maximum posted 3 miles per hour prima facie speed limit immediately prior to and after the business activity district if establishing a 25 miles per hour speed limit. 3. A maximum posted 25 miles per hour prima facie speed limit immediately prior to and after the business activity district, if establishing a 20 miles per hour speed limit. 4. Met the definition of"Business Activity District" defined in CVC Section 22358.9. Section 4. Reduction of Speed Limits in Proposed"Business District" Streets. Determines that the prima facie speed limit for the proposed portions of the street stated in Exhibit A is reduced by five mph. Section 5.CVC Section 22358.4 Findings.Finds pursuant to CVC Section 22358.4 that the roads stated in Exhibit B are a maximum of two traffic lanes and have a maximum prima facie speed limit immediately prior to and after the school zone. And has determined the need to lower the prima facie speed limit has considered the safety of bicyclists and pedestrians including children, the residential density, and the road conditions. Section 6. Reduction of Speed Limits in Proposed School Zones. Determines that the prima facie speed limit for the proposed portions of the street stated in Exhibit B is 15 mph for both directions of travel, when approaching, at a distance of less than 500 feet from, or passing, a school building or the grounds of a school building, Ordinance No. 2887 N.C.S. Page 2 DocuSign Envelope ID:422D6DEE-11F6-4EB6-B192-14997571F117 contiguous to a highway and posted with a school warning sign that indicates a speed limit of 15 miles per hour, while children are going to or leaving the school, either during school hours or during the noon recess period. The prima facie limit shall also apply when approaching, at a distance of less than 500 feet from, or passing, school grounds that are not separated from the highway by a fence, gate, or other physical barrier while the grounds are in use by children and the highway is posted with a school warning sign that indicates a speed limit of 15 miles per hour. Section 7. Effective Date. The reduction of speed limits stated in Sections 4 and 6 of this Ordinance shall not be effective until appropriate signs giving notice of the speed limit are erected upon the portions of the street stated in Exhibits A and B, and no sooner than thirty (30) days after the date of its adoption by the Petaluma City Council. Section 8. Severability. If any part of this ordinance is for any reason held to be unconstitutional, unlawful, or otherwise invalid by a court of competent jurisdiction, such decision will not affect the validity of the remaining parts of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each of its provisions irrespective of any part being held invalid. Section 9. Posting/Publishing of Notice. The City Clerk is hereby directed to post and/or publish this ordinance or a synopsis of it for the period and in the manner required by the City Charter. The City Clerk is also hereby directed to file a Notice of Exemption concerning this ordinance with the Office of the Sonoma County Clerk in accordance with Section 15062 of the CEQA Guidelines.
