HomeMy WebLinkAboutResolution 92-134 06/01/19920 Resolution No. 92-134 N ~.s. .; of the City of Petaluma, California A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALU1ViA TO IMPOSE A 24-HOUR BAN ON FIREWORKS ANI~ ALCOHOL IN LUCCHESI PARK ON JULY 4, 1992 WHEREAS, the Fourth of July fireworks display at Lucchesi Park is a popular annual City event, drawing large numbers of citizens; and WHEREAS, through the providing of the annual fireworks display, the City of Petaluma gives citizens an opportunity to celebrate the 4th of July in a safe and controlled environment; and WHEREAS, through the enactment of a temporary ban of fireworks and alcoholic beverages in Lucchesi Park during the 1991 Fourth of July celebration, families were able to enjoy the fireworks display in a safe and friendly atmosphere; and WHEREAS, Petaluma Municipal Code section 1.04.O10.K provides for the enactment of a temporary or special law in the form of a resolution which shall constitute a law of the City; and WHEREAS, Petaluma Municipal Code section 1.12.010 provides that persons authorized to enforce municipal ordinances, including those defined in Petaluma. Municipal Code section 1.04..010.x, may arrest or issue citations for violation of said ordinances or other law. Rcs. No . ................._........... N.C.S. 92-134 ..-, 7 8 9 0 1 2 3 4 5 6 7 8 9 0 1 2 3 NOW, THEREFORE, LET IT BE RESOLVED THAT the City Council of the City of Petaluma, do hereby authorize aone-day ban of fireworks and alcoholic beverages in Lucchesi Park from 1:00 a.m. July 4, 1992 until 8:00 a.m. July 5, 1992; and BE IT FURTHER RESOLVED THAT violation of this resolution shall constitute an unlawful act in a city park, which. act shall be an infraction subject to a fine upon conviction of not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00) for a first offense; not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00) for a second offense; and not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for a third and subsequent offense committed during the period of time covered by this temporary special law. Any citations issued pursuant to this resolution shall cite violation of Petaluma Municipal Code section 13.28.180. jc/nb/4th92res/#39 Under the power and authority conferred upon this Council by the Charter of said City.
