4 DENYING APPEAL OF THE DECISION OF THE
5 SITE PLAN AND ARCHITECTURAL REVIEW COMMITTEE
6 TO APPROVE INSTALLATION OF A FENCE AT
7 WASHINGTON SQUARE SHOPPING CENTER

10 WHEREAS, on February 13, 1992, the Site Plan and Architectural Review Committee
11 granted conceptual approval to install a fence along the westerly property boundary of
12 Washington Square Shopping Center, AP No. 007-280-73, subject to redesign; and.,
13
14 WHEREAS, an appeal. of the Site Plan and Architectural Review Committee decision was
15 appropriately filed by the adjacent property owner, Village Properties, on February 26,
16 1.992, stating objection to installation of a fence which would preclude pedestrian cross-
17 access between the two properties; and

19 WHEREAS, the City Council has held a public hearing to consider the appeal and all
20 reports, documentation and testimony submitted on the matter.;

22 NOW THEREFORE BE IT RESOLVED that the City Council finds as follows:

24 1. The Site Plan and Architectural Review Committee acted appropriately in its
2.5 decision of February 13, 1992.
2b 2. The proposed fence, as conceptually approved, will not prevent the
27 preservation and enjoyment of substantial property rights possessed by other
28 properties and does not constitute a special privilege of the applicant not
29 enjoyed by his neighbors.
30 3. The proposed fence, as conceptually approved, will not be of substantial
31 detriment to the adjacent properties, and will not materially impair the
32 ability of the two properties to service the community interdependently as a
33 commercial center.
34 4. The proposed fence, as conceptually approved, will conform to the
35 requirements and intent of the Zoning Ordinance and Petaluma General
36 Plan, and will not constitute a nuisance or be detrimental to the public
37 welfare of the community.

39 BE IT FURTHER RESOLVED that the City Council hereby denies the appeal of Village
40 Properties, and that installation of a continuous fence shall be permitted upon redesign to
41 SPARC approval.
