3 APPROVING ISSUANCE OF A MITIGATED NEGATIVE DECLARATION
4 PURSUANT TO CEQA FOR AMENDMENTS TO THE GENERAL PLAN
5 LAND USE MAP

8 WHEREAS, the City received applications from the following persons and organizations
9 for amendments to the General Plan Land Use Map as described below:

11 A. Lizak - to remove the "proposed park" symbol from a 1.48 acre parcel behind
12 the Veteran's Memorial Building, at the corner of McNear Avenue and
13 Mission Drive, APN 008-471-36 (the environmental review also included
14 subdividing this property).

16 B. United Church of Christ - to change approximately 0.83 acres of the Church's
17 property, located at the corner of Mission and Middlefield Drives, from
18 "Public and Institutional" to "Urban Standard", APN 008-471-36.

20 C. Capri Creek -amend map to show existing creek alignment and 200 foot
21 wide open space corridor easterly of Ely Boulevard, APN 136-120-01 and
22 137-070-16; and

24 D. Dow Dermatologics - to change the land use designation of the property
25 located at 951 Petaluma Boulevard South from Public Institutional to
26 Thoroughfare Commercial, portion of APN. 008-530-03, (the environmental
27 review also included a Use Permit for this property).

29 WHEREAS, the Capri Creek amendment was found to be exempt from the California
30 Environmental Quality Act (CEQA) pursuant to State Guidelines sections 15305, 15307
31 and 8, 15317 and 15316; and

33 WHEREAS, initial. studies were prepared for the Lizak, United Church of Christ, and Dow
34 Dermatologies amendments; and
35
36 WHEREAS, the results of these studies indicate that these amendments, as conditioned,
37 will not cause any significant adverse environmental impacts; and

WHEREAS, the Planning Commission held public hearings on these matters March 24,
April 28, and June 23, 1992, and considered the potential environmental impacts of these
amendments prior to making their recommendation for issuance of a Negative
Declaration; and
WHEREAS, adequate mitigations of environmental impact will be incorporated as
conditions on the Lizak and United Church of Christ subdivision maps;
NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative
Declaration pursuant to CEQA is hereby approved, based on the. following findings and
incorporating the following mitigation measures:
Standard Findings:
1. On the basis of the Initial Study and any comments received there is no substantial
evidence that the project, as mitigated, will have a significant effect on the
environment.
2. An Initial Study has been conducted by this lead agency, which has evaluated the
potential for this project to cause an adverse effect -- either individually or
cumulatively -- on wildlife resources. For this purpose, wildlife is defined as "all wild
animals, birds, plants, fish, amphibians, and related ecological communities,
including the habitat upon which the wildlife depends for its continued viability."
(Section 711..2, Fish and Game Code).
3. The amendments, as mitigated, do not have the potential to degrade the quality of
the environment, substantially reduce the habitat of a fish or wildlife species, cause
a fish or wildlife population to drop below self-sustaining levels, threaten to
eliminate a plant or animal community, reduce the number or restrict the range of a
rare or endangered plant or animal or eliminate important examples of the major
periods of California history or prehistory.
4. The amendments, as mitigated, do not have the potential to achieve short-term, to
the disadvantage of long-term, environmental goals.

5. The amendments do not have impacts which are individually limited, but
cumulatively considerable.
6. The amendments, as mitigated, do not have environmental effects which will cause
substantial adverse effects on human beings, either directly or indirectly.
Mitigations for Dow Dermatoloig_cs:
1. The owner shall submit an offer of dedication of a 25' public access easement along
the northern boundary adjacent to the River for public access in the event that these
areas are needed for the City's River Access and Enhancement Plan subject to
approval by City staff prior to the occupancy of the building. Any future expansion
of this use or any other use on this site shall include provisions for public access
along the river and to the river from Petaluma Boulevard South.
2. The parking lot shall be modified to include a truck loading zone. All truck
deliveries and pick-ups shall take place on site. No delivery trucks shall be parked
on Petaluma Boulevard South. The applicant shall make any changes to the
driveway and parking lot necessary to provide access for truck deliveries subject to
approval by the City Engineer prior to issuance of any tenant improvement building
permits or electrical permits and prior to the occupancy of the building.
Mitigations F'or United Church of Christ:
1. Future development plans/grading plans for this site shall incorporate design
features that minimize grading, subject to administrative site plan and architectural
review and approval. (Examples include: raised foundations, stepped floor plans,
reduced driveway lengths and shared driveways were possible). Special
consideration shall be incorporated to insure preservation of mature oak on site.
2. Establish or arrange building envelopes, as a part of the subsequent parcel map, in a
manner that preserves views through the site from Middlefield and Mission Drives,
subject to administrative site plan and architectural review and approval. The
establishment of an Open Space Easement over hillside portions.

1 3. Future building development plans shall incorporate a low profile design in order to
2 reduce building heights, subject to administrative site plan and architectural review
3 and approval.
