HomeMy WebLinkAboutResolution 92-238 09/08/1992"~ Resolution No. 92-238 N ~.5. 1 of the City of Petaluma, California 2 RESOLUTION ACCEPTING THE ENHANCEMENT 3 PLAN FOR THE PETALUMA MARSH WHEREAS, the City of Petaluma was requested by Petaluma People Services Center to participate in a study of approximately 150 acres of marsh, riparian corridors, and riverfront areas to identify opportunities for habitat protection and restoration, increased public access, and logical boundaries between sensitive habitat and developable lands; and WHEREAS, such a study would be prudent planning practice by scientifically reviewing a succinct geographic area and developing apro-active multi-objective, mutually supporting plan before any development proposals are received for the area; and WHEREAS, the California State Coastal Conservancy provided grant funding of $67,500.00 to the City for such a study; and WHEREAS, the plan was prepared for the City by Questa Engineering in close coordination with pertinent regulatory agencies; and WHEREAS, the draft plan was reviewed by the affected property owners and their comments received responses by City staff; and WHEREAS, the consensus nature of the final plan should expedite future approvals for implementing components of this plan and future development on the non-sensitive portions of the properties; and WHEREAS, acceptance of this plan does not amend the General Plan or Zoning Ordinance; and WHEREAS, the studies conducted as part of the plan confirmed as appropriate the areas designated as Industrial as shown on the General Plan Land Use map; and WHEREAS, acceptance of this plan does not obligate the City or property owners to implement the plan; and WHEREAS, acceptance of this plan still allows flexibility for the City, future developers, and regulatory agencies to allow alternate designs so long as the general objectives are met; and 92-238 N.cs. 1 Res. WHEREAS, it is the intent of the City to balance implementation of the biotic enhancement and access components so that there will be no significant adverse effect to the natural environment; and WHEREAS, a negative declaration. was adopted for this plan; and WHEREAS, the plan was reviewed by the Recreation, Music and Parks Commission and the Planning Commission, both of whom recommended Council acceptance of this plan; NOW, THEREFORE, BE IT RESOLVED that the City Council accepts the Enhancement Plan for the Petaluma Marsh (dated December 1991) provided it is amended to reflect the following changes and corrections recommended by staff and the Planning Commission: 1. Table 7, item 18 shall be amended to Migration Corridor, not Mitigation Corridor. 2. Correct the MHHW discrepancy between pages 1.5 and 16. 3. Correct the site history section. 4. Change "boat ramp" to "boat deck" on page 26. 5. Change Figure 10 to: a. Remove implication that fence line is or should be property line. b. Show alternate access route and parking area on city landfill property. c. Show width of upland (easterly or fence line) buffer zone to be "determined at time of development or implementation". 6. References to or implications of reserved parking for pathway users on the marina site shall be removed. resEnhan /council-8 Under the power and authority conferred upon this Council by the Charter of said City.
