5 A RESOLUTION OF THE CITY COUNCIL OF TIME CITY OF PETALUMA
6 AUTHORIZING OFFERS OF AGREEMENT TO "FREE WATER USERS"

9 WHEREAS, the City of Petaluma will place the City Water Filter Plant, located on Manor
10 Lane, out of service October 1, 1992; and
11 WHEREAS, the City is now and has for many years supplied "free water" to its "free water
12 users" out of the water distribution system of the City of Petaluma; and
13 WHEREAS, these "free water" rights were obtained as a result of granting the City's
14 predecessors in interest the right to divert all of the water out. of a stream commonly known as
15 Adobe Creek and convey the same away in pipes and aqueducts; and
16 WHEREAS, the "free water users", dispute the City's contention that the City would no
17 longer be obligated to provide this "free water" to the "free water users" when the City Water Filter
18 Plant is placed out of service; and
19 WHEREAS, the City seeks in good faith to acquire any rights the "free water users" may
20 have to receive "free water" .
21 NOW, THEREFORE, BE IT RESOLVED as follows:
22 1. The City Council authorizes staff to provide and install water services from the City's
23 Zone IV water system to service these ranches.
24 2. The City Council authorizes the offer of non-transferrable conditional use agreements
25 to provide "free water" to the following named "free water users" for the existing
26 uses on the described properties in the maximum yearly quantities as stated:
27 A. Raymond R. and Marilyn N. Gambonini, owners of property in Petaluma,
28 California, APN 017-110-081, commonly known as the Gambonini Ranch:
29 1,750,000 gallons of water per calendar year for fifteen (15) years from the
30 date of this resolution.
31 B. Jose P. Silva, Rita M. Silva, Louis S_ Borges, Maria S_ Borges, Libeito
32 Mota and Alda I). Mota, owners of property in Petaluma, California, APN
33 017-080-03, commonly known as the Reibli Ranch: 1,750,000 gallons of
34 water per calendar year for .fifteen (15) years from the date of this resolution.
35 C. Antoinette M. Brazil, owner of property in Petaluma, California, APN 017-
36 080-OS-2, commonly known as the Brazil Ranch: 361,000 gallons of water
37 per calendar year for fifteen (15) years from the date of this resolution.

of water per calendar year for fifteen (15) years from the date of this
