HomeMy WebLinkAboutResolution 92-232 09/08/1992;~ Resolution No. 92-232 N.C.s. 1 of the City of Petaluma, California 2 RESOLUTION AMENDING THE PUD ZONING DISTRICT DEVELOPMENT 3 STANDARDS FOR PARK PLACE SUBDIVISION UNIT III LOCATED IN THE 4 'VICINITY OF MCDOWELL BOULEVARD NORTH AND RAINIER AVENUE 5 6 WHEREAS, by Ordinance No. 1532 N.C.S. adopted October 4, 1982, Park Place 7 Subdivision Unit 3 was rezoned to PUD (Planned Unit District); and 8 9 WHEREAS, by Resolution No. 84-257 adopted October 15, 1984, PUD development 10 standards were established by the City Council for Park Place III Subdivision which 11 prohibited garage conversions; and 12 13 WHEREAS, application was filed by Mr. Arthur Luellen, a homeowner within Park Place 14 III, to amend the PUD Development Standards to allow garage conversions to living space 15 within .detached single-family residences within the Park Place III subdivision; and 16 17 WHEREAS, by action taken on July 28, 1992, subsequent to a public hearing on the same 18 date, pertaining to this matter, the Planning Commission recommended adoption of the 19 proposed amendment to the Park Place III Standards in said Planned Unit District; 20 21 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts the 22 following findings: 23 24 Findings for PUD Amendment: 25 1. The proposed amendment to the Park Place III Development Standards has been 26 determined categorically exempt from the requirements of the California 27 Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA 28 Guidelines. 29 30 2. The amendment to the Park Place III Development Standards is in substantial 31 conformance with the City of Petaluma General Plan. 32 33 3. The nature and scenic qualities of the site remain protected with adequate available 34 public and private spaces as designated on the Unit Development Plan. 35 36 4. The amendment to the Park Place III Development Standards as proposed by the 37 applicant and conditioned by the City will not be detrimental to the public welfare, tt~5. No............9.2.0.232 N.c.s. 1 1 will be in the best interest of the City and will be in keeping with the general intent 2 and spirit of the Zoning Regulations of the City of Petaluma and with the Petaluma 3 General Plan. 4 5 BE IT FURTHER RESOLVED, based on the findings set forth above, that the City 6 Council hereby approves amendment to the Development Standards for Park Place 7 Subdivision Unit III to allow garage conversions to lifing space within detached single- 8 family residences subject to the conditions set forth below: 9 10 Conditions for PUD Amendment: 11 1. Three off-street parking spaces, conforming to City Standards and subject to staff 12 approval shall be provided. Where feasible, a parking space may be created in the 13 landscape strip between the driveway and the side property line. 14 15 2. Landscaping, subject to staff approval, shall be retained along the property line. If 16 there is not sufficient area to provide landscaping after the creation of the parking 17 space, alternative paving materials, such as pavers or ribbon driveways, shall be 18 used, subject to staff approval. 19 20 3. Landscaping, including a full front lawn, one street tree and six (6) shrubs shall be 21 maintained, per the original PUD. 22 23 4.
