HomeMy WebLinkAboutResolution 92-231 09/08/19921_ FZesolution No. 92-231 N ~.5. ,~ 1 of the City of Petaluma, California 2 RESOLUTION AMENDING THE PLANNED UNIT DEVELOPMENT CONDITIONS 3 OF APPROVAL FOR THE CHATEAU SENIOR HOUSING PROJECT AT 4 333 NORTH MCDOWELL BOULEVARD 5 (APN 007-350-04/05; FILE NO. REZ92007) 6 7 WHEREAS, on November 14, 1988, the City Council adopted Resolution No. 88-366 upon 8 recommendation of the Planning Commission conditionally approving the Planned Unit 9 Development Plan fora 300 unit Chateau Senior housing project located at 333 North 10 McDowell Boulevard; and 11 12 WHEREAS, on June 1st, 1992, Greenbrae Management Corporation applied for an 13 amendment to the Planned Unit Development conditions of approval relating to noise 14 mitigations and the size of individual unit kitchens; and 15 16 WHEREAS, a public hearing was held before the Planning Commission on July 28, 1992, 17 and the Planning Commission recommended that the City Council approve the proposed 18 changes to the conditions of approval as stated in their minutes of that meeting; and 19 20 WHEREAS, a Negative Declaration was prepared and circulated pursuant to the 21 California Environmental Quality Act, and was adopted by the City Council on August 17, 22 1992 (Resolution No 92- 2 30 )upon the recommendation of the Planning Commission. 23 24 NOW, THEREFORE, BE IT RESOLVED that all other conditions of Resolution No. 88- 25 366 not listed below remain in effect. 26 27 BE IT FURTHER RESOLVED that the City Council makes the following findings in 28 regards to the PUD amendment: 29 Findings: 30 1. The changes to the development plan results in a more desirable use of the land and 31 abetter physical environment by allowing retention of the balconies as originally 32 designed and eliminating the need for a large unattractive sound wall. 33 34 2. The changes to the development plan will not be detrimental to the public welfare, 35 will be in the best interest of the City, and will be in keeping with the general intent 36 and spirit of the zoning regulations and noise standards established by the General 37 Plan of the City of Petaluma. 38 Hes. rvo ...............9 2-2 31N.c.s. 1 ' 1 3. The removal of the soundwall will not result in a significant increase in the noise 2 experienced by the future residents of the project. Any additional noise impacts 3 resulting from the Rainier project will be mitigated at that time by the property 4 owners. 5 6 4. The traffic mitigations adopted for the original project adequately addressed the 7 additional traffic which may result from units with full size kitchens. 8 9 BE IT FURTHER RESOLVED that the City Council hereby approves the proposed 10 amendments to the conditions of approval for the Chateau Planned Unit Development 11 Plan, as originally stated in Resolution No. 88-371, as follows: 12 13 5. The mix of residential units may be amended provided that no more than 85 14 two bedroom units are provided, nor more than 270 units-(with full size 15 kitchens). Any such amendments must be reviewed and approved by the 16 Planning Director. Amendments beyond the parameters of this condition 17 require approval by the Planning Commission and City Council as a PUD 18 amendment and may require additional traffic analysis. 19 20 21. The recommendations for the Sound Solutions noise shall be incorporated 21 into the project design, to the satisfaction of the Planning Director and Chief 22 Building Official except: 23 24 a) No barrier shall be required along the U.S. 101 property 25 boundary as shown in Figure 2 of the Sound Solutions study 26 prepared for the project. In the event that Cal-Trans requires 27 that a sound wall be constructed along Highway 101 adjacent 28 to the Chateau project or the sound wall is included in the 29 public improvement. project as a mitigation measure for noise 30 impacts associated with the Rainier overpass/interchange 31 project or other similar City of Petaluma Highway 32 improvement project (e.g., Rainier or approved alternative) 33 the Owner of the Chateau shall, upon receipt of written 34 demand by the City, be responsible for the construction of such 35 wall, or for the expense thereof; design, location and 36 installation timing subject to City approval. The owners of the Reso. 92-231 NCS 2 1 Chateau shall be relieved of their responsibility to construct 2 the sound wall if construction on the Rainier or similar 3 highway project is not commenced within ten years of the 4 adoption of this resolution. An acceptable means of assuring 5 said construction (e.g., performance bond, good faith cash 6 deposit, deed restriction, etc.) shall be provided to the City 7 prior to the issuance of a building permit to the satisfaction of 8 the City Manager. 9 10 b) Exterior balconies adjacent to Highway 101 shall not be 11 considered outdoor living spaces and thus shall be exempt from 12 the City's outdoor living space noise standards established by 13 the Petaluma General Plan. 14 15 31. Parking shall be provided at a ratio of at least .65 spaces per unit with a full 16 kitchen and .4 spaces/unit for all others. At least 10 spaces shall be suitable 17 for handicapped vehicles. 18 19 20 chatres/dd4 Under the powez and authority conferred upon this Council by the Charter of said City.
