HomeMy WebLinkAboutResolution 2006-187 N.C.S. 11/06/2006 Resolution No. 2006-187 N.C.S. of the City of Petaluma, California RESOLUTION ACCEPTING COMPLETION OF THE CONSTRUCTION CONTRACT FOR THE PETALUMA AIRPORT HANGAR EXPANSION, PROJECT NO. C100103 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Petaluma Airport Hangar Expansion Project ("Project"); and, WHEREAS, bids for the Project were opened on July 22, 2004, in accordance with California Public Contract Code Section 4105.5 and other applicable law; and, WHEREAS, the apparent low bid for the Project was the bid of North Bay Construction in the amount of $4,783,245.10; and, WHEREAS, by Resolution No. 2005-038' N.C.S. adopted March 21, 2005, the City Council of the City of Petaluma found the bid of $4,783,245.10 for the Project to be the lowest responsive. bid and awarded the Project to North Bay Construction in the amount of $4,783,245.10 conditioned on North Bay Construction's timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any change orders and other amendments to the Project contract that are necessary to effectively complete the Project and/or to realize the Project and/or cost benefits for the. City so long as such change orders or amendments do not result in an increase in excess of five (5) percent of the total Project amount; and, WHEREAS, the following change orders affecting the Project amount have been approved: Change Order Amount Number 1 $(267,695.28) 2 - $(49,313.75) 3 $3,288.00 4 $21,975.60 5 $37,735.00 6 $16,859.00 7 $8,140.22 8 $147,881.50 9 $2,000.00 Total Change Orders: ($83,129.71); and WHEREAS, the final contract amount as amended including all change orders is $4,709,802.37; and, Resolution No. 2006-187 N.C.S. Page 1 WHEREAS, City authorized acceptance of the hangar portion of the Project on June 5, 2006, Resolution 2006-098 N.C.S. and authorized staff to proceed with a contract change order to seal coat the taxiway under the same contract; and, WHEREAS, City staff have inspected the Project and determined that it has been completed in accordance with the contract regturements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and, WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The contract entitled Petaluma Airport Hangar Expansion Project No. C 100103, with a final contract amount of $4,709,802.37, is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3. Staff are hereby authorized and directed to release all undisputed retention, not subject to pending change orders, immediately for the hangar portion of the Project and within forty-five (45) days of the date of this Resolution for the taxiway seal coat portion of the Project and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law. Under the power and authority conferred upon this Council by the Charter ofsaid City.
