(CHAPTER 13.40 OF THE PETALUMA MUNICIPAL CODE) AND REPEALING RESOLUTION $6-60 N.C.S. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 BE IT RESOLVED that the following fees are established pursuant to Section 13.40.100 of the Petaluma Municipal Code. SECTION 1. Permit Application Fee Each applicant for a film permit shall pay anon-refundable permit application processing fee in the amount of $100.00. SECTION 2. City Employee Fee The applicant shall pay the City's cost for providing City employees including Police, Fire, and Public Works employees for the particular filming activity. The fee for City employees' services shall be computed as follows: The actual hourly rate for the employee's job classification (either straight time or overtime) (+) plus hourly benefits (+) plus 15 % administrative fee. A fee deposit shall be required prior to the filming activity based on the estimated hours each City employee will be required for the filming activity. If the total actual costs for City employees' services are greater than the fee deposit, the applicant will be billed for the difference. If the actual costs are less than the deposit, the City will refund the difference to the applicant. SECTION 3. City Barricades and Street Cleaning Fees Fee for use of City barricades - $5.00 to $20.00 per unit per day. Fee for City street cleaning - $75.00 an hour (Man & Equipment). 92-272 Res. N.C.S. 1 ~,x 4 ~. 1 Fee for other Public Works Department: equipment will be determined 2 by the Department Head and will `be based, when applicable, on standard CALTRANS 3 equipment. rate schedules. 4 5 A fee will be charged for set-up and removal of City traffic control 6 devices based on the actual work time of the City employee(s) as specified in Section 2 7 above. 8 9 SECTION 4 City Vehicles Fees 10 11 ~ Fee for use of police vehicle on camera $100.00 per hour, (Man & 12 ' Equipment). 13 14 Fee for use of other City vehicles as determined by the appropriate 15 Department Head will be based, when applicable, on standard CALTRANS 16 ~ vehicleYequipment rate schedules. 17 18 SECTION 5 Cleanup/Security Deposit or Bond 19 20 The City shall require that an applicant for a filming permit involving a 21 filming activity located in a City Park, City Hall, City street, or other City owned 22 property shall. pay a .refundable clean/up security deposit or post a bond in the amount 23 of $1,000, or in "such greater amount as determined by the City Manager. Exception: 24 no security deposit is required if the applicant's sole use of City property will be for 25 parking of vehicles, with the actual filming occurring on private property. Any deposit 26 greater than $1,000 shall be based on the estimated time necessary for cleanup after the 27 filming activity, and risk of property damage involved. The deposit is fully .refundable 28 if City property is properly cleaned and restored immediately following the filming 29 activity by the permittee. If City property used for the filming activity has not been 30 properly cleaned and/or .restored, the permittee shall be billed for the costs incurred by 31 the City of Petaluma .for cleanup and restoration, and the cleanup security deposit (or a 32 portion thezeof) shall be applied to payment of the bill. If the film permittee disputes 33 'the bill .for cleanup/restoration, he may appeal within 5 days of receipt of the bill to the 34 City Manager. Reso. 92-272 NCS Page 2 of 3 1 SECTION 6 Street Use Fee 2 3 A fee of $500 per day will be assessed for any street closure, regardless 4 if the closure is full time or intermittent and regardless of the duration of the closure(s) 5 except arterial streets for which the fee shall be $1,000. All requests for street closures 6 except as otherwise noted, may be granted administratively. 7 8 SECTION 7 Community Inconvenience 9 10 In order to retain community .good will, the applicant may be required to 11 make a contribution to a local charity or non-profit organization in those circumstances 12 where the filming impacts the community beyond a specific residence or neighborhood. 13 The contribution is separate from any other fees required by this resolution. 14 15 SECTION 8 Pre-Payment of all Fees and/or Deposits 16 17 The application fee shall be paid by the applicant at the time the 18 application is submitted to the City. All other fees and deposits shall be paid by the 19 film permit applicant prior to the issuance of a film permit. 20 21 SECTION 9 Waiver of Fees 22 23 Fees and deposits may be waived or reduced for student film projects or 24 public service filming at the discretion of the City Manager.
