HomeMy WebLinkAboutResolution 2006-183 N.C.S. 11/06/2006 Resolution No. 2006-183 N.C.S. of the City of Petaluma, California RESOLUTION ACCEPTING COMPLETION OF THE SHOLLENBERGER FISHING PIER PROJECT NUMBER C400105 WHEREAS, the City of Petaluma and the County of Sonoma entered into an agreement for the relocation of the original Shollenberger Park in order to construct the Petaluma Marina; and, WHEREAS, part of the agreement between the City of Petaluma and the County of Sonoma required the construction of a fishing pier on the Petaluma River that was ADA accessible; and, WHEREAS, on July 11, 2005, the Petaluma City Council awarded the contract to construct a fishing pier in Shollenberger Park to Mas Aqua of Santa Rosa, California; and, WHEREAS, the firm of Mas Aqua of Santa Rosa, California has constructed the required fishing pier in Shollenbeger Park per plans and specifications for a total amount of $105,401 which is within budget; and, WHEREAS, City staff and the project manager, Questa Engineering of Pt. Richmond, Calif. have inspected the project and recommended acceptance ofit as completed per plans and specifications. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: a. The Shollenberger Fishing Pier Project (C400105) with a final contract amount of $105,401 is hereby accepted as completed per plans and specifications, and subject to the Contractor's continuing warranty and other obligations pursuant to the contract. Resolution No. 2006-183 N.C.S. Page 1 b. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with the Sonoma County Clerk's Office within ten (10) days of the date of this resolution. c. Staff are hereby authorized and directed to release all undisputed retention subject to pending change orders within forty-five (45) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law.
