RESOLUTION APPROVING AMENDMENTS TO THE
GENERAL PLAN LAND USE MAP
WHEREAS, the California Government Code and City of Petaluma General Plan allow
periodic changes to the General Plan; and
WHEREAS, recent activity by the Planning Commission revealed a desired amendment to
the Land Use Map, described as follows:
12 A proposed General Plan Amendment to change the land use designation of a
13 200' ± portion of APN 008-472-10 (approximately 4 + acres) along an unnamed
14 seasonal creek from "Public Park" to "Open Space". The change is required as a
15 mitigation measure for Country Club Estates Unit 2a and 3a (Resolution No. 92-
16 287) adopted by the City Council on November 2, 1992.

18 WHEREAS, a duly advertised public hearing on this General Plan amendment was held by
19 the Planning Commission on November 24, 1992; and
20
21 WHEREAS, all written and verbal testimony and staff reports were considered by the
22 Planning Commission before they made a recommendation on this matter; and

24 WHEREAS, the Planning Commission recommended that the City Council approve this
25 amendment subject. to certain findings; and
26
27 WHEREAS, the City Council held a duly advertised public hearing on this proposed
28 amendment on December 21, 1992, at which time all written and oral testimony, including
29 the Planning Commission's recommendation, was considered prior to rendering a decision
30 on this matter; and

32 WHEREAS, this amendment is a clarification of City policy and does not involve
33 construction or directly result in physical changes and will therefore have no potential to
34 cause a significant effect on the environment;

36 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby makes the
37 following findings with regard to the proposed amendment:

1. The proposed amendment to delete the public park designation is deemed to be in
the public interest because the stream represents a valuable natural resource, but is
inappropriate to develop as a public park.
2. The proposal is consistent with and further promotes the objectives, goals, and
policies of the General Plan to preserve open space areas along streams, (Policy 23,
p. 52); require dedication of open space easements along streams at time of
development (Program 26, p. 52); and to select park sites on the basis of safety and
consideration such as accessibility, topography, and visibility (Policy 13, p. 60).
3. The potential impacts of the project have. been assessed and it can be seen with
certainty that there is no possibility that the proposed General Plan Amendment
may have a significant effect on the environment or be detrimental to public health,
safety or welfare.
4. T'he project has been found to be exempt from processing under the California
Environmental Quality Act per Guidelines Section 15061(b)(3), the "General Rule"
exemption.
20 BE IT FURTHER RESOLVED that, based on these findings, the City Council hereby
21 approves the following amendment to the General .Plan Land Use Map:

23 Change the land use designation of a 200'+ portion of AP No. 008-472-10
24 (approximately 4 + acres) along an unnamed seasonal creek from "Public Park" to
25 "Open Space".
