NO. a7 fa MEMORANDUM OF U.NDERRSTANDIN.G' Between THE CITY OF PETALUMA And LABORERS' INTERNATIONAL UNION OF.NORTH_ AMER2,CA, LOCAL 139 (PETALUMA) This document represents t'he City of Petaluma's,final and complete Agreement resulting from. the' 1976-77 Meet and Confer sessions with Laborers' International Union of North America, Local 139 (Petaluma). Representatives of the City and,Laborers' 139 (Petaluma) acknowledge that they have fulfilled their mutual and re:spe:ctive obligations to Meet and Confer under' the-Meyers-Milias-Brown'Act. As a result, the parties have.come to a mutual understanding•whic,h the representatives of the City and Laborers'.139 (Petaluma), who. have the approval of their members, agree to recommend for acceptance and approval to the City Council of. the City of Petaluma. The expressed provisions hereof represent ai,l the changes to be made in the terms and condition's of employment o:f the employees in Unit 2 ('Maintenance). Therefore, all other terms, conditions and provisions contained in that certain document entitled "Agreement Between the City of Petaluma and Laborers' Int.er:nat,ional Union of North America, Local 139", with the effective date of July 1, 1975, not changed hereby shall remain in full force and effect. Workers' Compensation: Benefits shall,be payable in situations where employee absence is due to industrial injury as provided in California State Workers' Compensation Law. The amount of disability payments paid to'the injured employee shall be deducted from salary payable to the employee while on sick leave. During the first three (3) calendar days of absence for industrial disability,"employees will be -compensated at their full rate of pay without deduction from sick leave unless they are hospitalized. Absences resulting in immediate hospitalization or absences continuing beyond the third day shall be charged against the employee at the rate of one-half (1/2) day for each day of absence credited or compensated by workers' compensation insurance, provided the City receives all compensation paid by workers' compensation insurance. The injured employee may choose to receive workers' compensation payments only, without City.payment for salary at no loss of sick leave. Sick leave for industrial injury shall not be allowed for a disability resulting from sickness, self-inflicted injury or willful misconduct. (Item B) Article 28 Title to read as follows: Group Health, Life and Dental Insurance Programs (I.tem C) Article 28, Section 1, to read as follows: 1. City of Petaluma Group Medical -Hospital Insurance Program: The City shall provide for a medical -hospital insurance program. The City agrees to,pay the increased cost of medical -hospital insurance premiums for the employee for 1976-77, which amounts to a total premium payment of $43.03 per month per employee. The City agrees to pay during 1976 -77 -the amount of $15.00 per month.per employee towards the cost of dependent(s) coverage for medical and hospital insurance premiums for all employees who maintai-n dependent(s) coverage.. (Item D) Article 28, Section 2, to read as fol ows: 2. City of Petaluma Group Term -Life Insurance Program: During the gime of this agreement, the City agrees to provide, at the. premium cost of $2.40' per month per employee, group term life insurance coverage in the principle amount of $5,000 per employee. 0 1 10 Article 28, add Section 3, to read as follows: 3. City of Petaluma Group Dental Insurance Program: The City shall provide for an employee group dental insurance program for City employees in Unit 2 -during 1976-77. The City agrees to pay the employee premium amount -of $6.34 per month per employee land the dependent, premium amount of $13.50 per month per eznployee.towards the City Program. The schedule of benefits shall be as set forth in the City of Petaluma Employee Group Dental Insurance Program. (Item F) Article 31', Section .2, to read as follows: 2. The Union agrees to submit its demands for the year 1977-78, no later than April -1, 1977. The City agrees that it will commence negotiations in April 1977. (Item G) Article 31, Section 5, to read as;fo`llo.ws: 5. The term of this Agreement shall commence on July 1, 1976, and continue until June 30, 1977, and from ;year to year, thereafter unless the parties desire to change, alter, amend or terminate this.Agre'ement, in which event a written notice shall be served by -either party n,in:ety (90) days prior to June 3.0, 1977, - setting forth a desire to negotiate, modifications or amendments to this Agreement. City will designate ten (10) paid, fix.ed-date.hol.idays per employee as listed. Additionally, during the fiscal year 1976-77, the City will authorize one (1) paid floating holiday per employee; which may be taken by the employee.at a time 'selected by the. employee, subject to operational requirements as determined by the Department Head. The ten (10) designated, fixed -date holidays to be observed for the fiscal year 1'976:=77 are listed below: 1. Independence Day July 4_, (to be observed July 5) 2.
