As a result, the parties have come to a mutual understanding which the represen- tatives of the City of Petaluma and the representatives of the Sonoma County Organization of Public Employees, Petaluma Chapter, who have the approval of their members, agree to recommend for acceptance and approval to the City Council of the City of Petaluma, as follows: 1. This Memorandum of Understanding shall be for a one year term for fiscal year from July 1, 1976 through June 30, 1977. V 2. Fwn g'®ree Asad � FJ�Po7: 3. Meet"ing and Conferring for the 1977-78 fiscal year will commence in April.,, 1977. 4. The City shall adjust on July 1, 1976, the existing salary ranges for each of the classifications included in represen- tational Units 3 and 4'by five percent (5'$).. 5. City of Petaluma Group Medical -Hospital Insurance Program: The City shall.proXide for a medical; hospital insurance program. The City agrees to pay the increased cost of medical -hospital ins;:uranc.e premiums for the employee. for 1976-77, which amounts to a total premium payment of $43.03 per month per employee. The City agrees 'to pay during 1976-77 the amount of $17.73 per month per employee towards the cost of dependents) coverage for medical and hospital insurance premiums for all employees who maintain dependent(s) coverage. 6. City of Petaluma Group Dental Insurance Progr.am: The, City s:hall provide for an employee group dental insurance progr:am,fo`r C„ity employees during 1976-77 with the City agreeing to pay the amount of $6.34 per month per employee toward the cost of the; prog'ram's insurance employee premium at the schedule of benefits provided in Appendix --'A". Authorized, City observed, paid Holidays 1976-77: In fiscal year 1976-77, the City will designate ten (10) paid fixed -date holidays per employee as listed below. Additionally, during the fiscal year 1976-7-7 the City will authorize one (1) paid floating holiday per employee, which may be taken by the employee at a time selected by the employee, subject to operational requirements as determined by the -Department Head. The ten (10) des,igna.ted, fixed -date holidays to be observed are listed below for fiscal year 1976--77: 1. Independence Day July 4, (to be observed July 5) 2. Labor Day 3. Columbus Day 4. Veterans' Day 5. Thanksgiving Day 6. Day after Thanksgiving 7. Christmas Day 8. New Year's Day 9. Washington's Birthday 10. Memorial Day 1st Monday in September 2nd Monday in October 4th Monday in October. 4th Thursday in November Friday after Thanksgiving (to be observed' on December 24) (to be observed on December 31) 3rd Monday in February Last Monday in May 8. Workers' Compensation: Benefits shall be payable in situations where employee absence is due to industrial injury as provided 'in California State Workers' Compensation Law. The amount of disability payments paid to th.e injured employee shall be deducted from salary payable to the employee while on sick leave. During the first three (3) calendar days of absence for industrial. -disability, employees will be compensated at their full rate.of pay without deduction from sick leave unless they are hospitalized. Absences resulting' in immediate hospital=ization or absences continuing beyond the third day shall be charged against the employee at the- rate of one-half (1/2) da_y for each day of absence credited or compensated' by workers' compensation insurance, provided -the City reeeive;s all compensation paid by workers' compensation insur:an=ce.. The injured employee may choose to receive workers' compensation payments only, without City payment for salary at no loss of si,ck.leave. Sick leave for industrial injury shall not be allowed for' a disability resul-ting' frdrasickness; self- inflicted injury or willful misconduct. Accrued Sick Leave Usage: Leaves of absence` up to four working days with pay per calendar year may be granted to an employee in the event of serious illness or injury in the employee's immediate family and will be charged against sick leave. The immediate family shall consist of the spouse, chiI dre"n, parents, brothers, sisters, or other individuals whose relationship to the employee is that of a dependent or near dependent. In each case, the appointing power shall grant such sick leave only when in his opinion, the relationship of the .sick or disabled person to the employee warrants such use of sick leave. 10. The parties agree that City of Petaluma, Personnel Rules and Regulations Rule XI, Section 1 Annual Vacation Leave shall be modified to read as pirov'ided in Appendix "B". ANNUAL VACATION LEAVE P.urpose:: The purpose. -of. annual vacation leave is. to enable each eligible employee to annually return to work mentally and physically refreshed. OW rave b the ti o ,Manager, �L s - When approved /1�, terminations 'I y y pay in lieu of vacation leave shall be at the employee's regular straight time rate times the number of hours of ' r accrued vacation leave.` Scheduling':; No more than fifteen (15) consecutive work days of vacation leave may be taken at one . time unless the department :head and the City Manager approve. The times during a calendar year in which, an employee may take vacation leave shall be determined by the department head with Page 2 of 2 DAB APPENDIX "B" (Cont.) due respect for' the wishes of the employee_and particular regard for the needs of the service. Annual vacation leave shall be scheduled, whenever practicable, so that an. employee takes at least two (2) consecutive weeks of vacation 'leave during each calendar year. vacation leave of less than five (5) days re- quires the prior approval of the City Manager. Under no cir- cumstances will vacation leave be taken for,less than one day. If the requirements -of the service are.such that an employee cannot take part or all of the vacation leave in a particular calendar year, such vacation shall be taken during the following calendar year when authorized by the City -Manager. In the event one or more municipal holidays fall within a vacation leave, such leave shall be extended accordingly. , All employees' vacation leave shall be requested in advance and shall be scheduled in accordance with the procedures established by the City Manager:. General Provisions: Any questions relative to interpretation of this Section shall be resolved by the City Manager whose .determination is final. For purposes of this Section, one (1) day is equivalent to eight (8) hours. All vacation leave time off shall be taken in incre- ments of 8 hours.
