Bates; RE.,, City Engineer Public Hearing to Adopt Resolution Ordering the Vacation and Abandonment of a Portion of Cherry Street Adjacent to St. Vincent High School. RECOMMENDATION It is recommended that the City "Council continue the item to October 17, 2011. BACKGROUND On June 20, 2011, the City Council considered the proposed right of way vacation of a portion of Cherry Street, adjacent to St. Vincent's High School. After receiving public comments, and following Council, deliberation, the City Council continued the item to August 1, 2011 and directed St. Vincent's to perform public. outreach to the neighboring community regarding activities and projects underway at the school. On July 7, 20.11, St. Vincent's held a neighborhood meeting at the school property to discuss various items including .the proposed snack shack, backstop extensions at the baseball diamond, installing' slat's in fencing, advertising signs as well as various operations and events at the school. Engineering and Planning staff attended the July 7th neighborhood meeting and were available to answer any questions. St. Vincent's personnel are in the process of working with the neighbors to address the items discussed at the July 7th meeting. There were no questions or discussions regarding the proposed right of way vacation at the neighborhood meeting. On August 1, 2011; the City Council continued this item until September 12, 2011. DISCUSSION Staff has,.maintained "regular communications with -the applicant to stay up fo date on;proposed neighborhood outreach. There ­have been delays in addressing neighborhood concerns' because of school starting an August and1herefore, St. Vince`nt`s&has requested. ad'dit'ional time, to address the various issues. Iri the: interest of meeting the Council's expectations'that St. Vincent's reach out'to.'tho neighboring community to fully address project issues, staff recommends that the project be continued to. October 17, 2011. Agenda Review: City Attorney Finance.Director City Manage i FINANCIAL, IMPACTS The project is subject to cost -recovery. All staff time, to date has been recovered through the project cost recovery system and'the project currently.,maintains-a positive balance. 2 n 2
