RESOLUTION MAKING SPECIFIED FINDINGS AND AUTHORIZING
AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT,
IN ACCORDANCE WITH STATE AND FEDERAL BIDDING REQUIREMENTS,
THE CITY CHARTER AND MUNICIPAL CODE,
AND STATE AND OTHER APPLICABLE LAW, WITH THE LOW BIDDER,
IN AN AMOUNT NOT TO EXCEED $300,000,
OR AUTHORIZING AND DIRECTING THE CITY MANAGER
TO FUND REMOVAL OF THE RAILROAD TRESTLE BRIDGE
BY THE U. S. ARMY CORPS OF ENGINEERS,
IN AN AMOUNT NOT TO EXCEED $300,000
(ESTIMATED REMOVAL COST PLUS CONTINGENCY)
WHEREAS, removal of the railroad trestle bridge is a key component of the last two
remaining contracts on the U.S. Army Corps of Engineers Petaluma River flood control project;
and,
WHEREAS, removal of this bridge structure is required to achieve the full 100-year
design level of flood protection because the bridge collects floating debris and restricts. flows;
and,
WHEREAS, the U.S. Army Corps of Engineers does not currently have adequate federal
funding to remove the railroad trestle bridge; and,
WHEREAS, staff continues to work with local legislatures to restore full federal funding
for completion of the Petaluma River flood control project; and,
WHEREAS, the Petaluma River flood control project includes construction of the
railroad industry track spur line to allow removal of the railroad trestle bridge; and,
WHEREAS, staff worked with the Corps to identify two alternatives for removing the
railroad trestle bridge before the coming rainy season as an emergency project, using local
funding to award a contract or provide funding to the U.S. Army Corps of Engineers; and,
WHEREAS, the Project Cooperative Agreement between the City and the Corps allows
for reimbursement of this emergency project cost upon the availability of federal funding; and,
WHEREAS, staff has determined that to proceed with the project on a timeline to allow
emergency removal of the railroad trestle bridge before the coming rainy season, it will be
necessary to award a contract or provide funding to the U.S. Army Corps of Engineers before the
next scheduled meeting of the City Council; and,
WHEREAS, removal of the railroad trestle bridge complies with the requirements of the
California Environmental Quality Act (CEQA) and the National Environmental Protection Act
Resolution No. 2006-178 N.C.S. Page 1
(NEPA) as a component of the work previously authorized on the Petaluma River federal flood
control project; and,
WHEREAS, emergency removal of the railroad trestle bridge requires approval from the
Sonoma Marin Area Rail Transit (SMART) and the North Coast Rail Authority (NCRA); and,
WHEREAS, NCRA informed staff they currently are not using the railroad trestle bridge
and do not object to the proposed emergency removal; and,
WHEREAS, the SMART Board of Directors is scheduled to consider emergency
removal of the railroad trestle bridge at their next meeting on October 18, 2006.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Petaluma hereby approves the project budget in the amount of $300,000 and authorizes and
directs the City Manager to:
1. Provide funding to the U.S. Army Corps of Engineers in and amount not to exceed
$300,000 for the Corps to undertake the project for emergency removal of the railroad
trestle bridge; or,
2. Award and execute the contract for emergency removal of the railroad trestle bridge
to the lowest responsible bidder, conditioned on timely execution of the contract and
submission of all required documents, including but not limited to executed bonds,
certificates of insurance, and endorsements, in accordance with the project bid
documents.
Under the power and authority conferred upon this Council by the Charter of said City.
