Existing facts 22 and circumstances that support that a significant exposure to litigation exists are reflected in requests 23 for additional compensation submitted by Kiewit Pacific Company to the City concerning the Ellis 24 Creek Water Recycling Facility project. Resolution 2011 -016 N.C.S. and PCDC Resolution 2011 -02 Authorizing Cooperation 30 Agreements between the PCDC and the City, Pledging PCDC Funds in Support of 31 Programs and Projects, Including Publicly Owned Improvements. 32 33 City Manager Brown 34 35 Mayor Glass 36 37 Public Comment on Item 1.A 38 39 George Weiner, Petaluma, asked if money could be set aside to repair or repave 40 Copeland Street. 41 42 Richard Brawn, Petaluma, said he did not feel this proposal had been adequately 43 thought through. 44 45 Zen Destiny, Petaluma, said that he supports tying up funds before the state steals 46 them from us. 47 48 Bryant Moynihan, Petaluma, stated that Governor Jerry Brown has proposed that 49 the cities can retain 42% of the incremental property taxes for bond financing. He 50 suggested that instead of dedicating all this money to projects, the City should 51 be paying down some of the bonds and not have that kind of exposure in the 52 future. January 31, 2011 Vol. 45, Page 457 1 2 Terry Kosewicz, Petaluma, spoke about the City Charter, the City Manager 3 Mission Statement, and the State of California Constitution.
