21 pursuant subdivision (b) of §54956.9 (California Government Code): one potential case. Existing facts
22 and circumstances that support that a significant exposure to litigation exists are reflected in requests
23 for additional compensation submitted by Kiewit Pacific Company to the City concerning the Ellis
24 Creek Water Recycling Facility project. Compensation requests will be made available for public
25 inspection on request.

42 Richard Brawn, Petaluma, said he did not feel this proposal had been adequately
43 thought through.

45 Zen Destiny, Petaluma, said that he supports tying up funds before the state steals
46 them from us.

48 Bryant Moynihan, Petaluma, stated that Governor Jerry Brown has proposed that
49 the cities can retain 42% of the incremental property taxes for bond financing. He
50 suggested that instead of dedicating all this money to projects, the City should
51 be paying down some of the bonds and not have that kind of exposure in the
52 future.
