Owner, in consideratiOn of value paid by CITY OF PETALUMA, a California
Municipal corporation, her City, the adequacy and receipt
whereof are hereby acknowledged, hereby grants to City a utility easement
including the right to excavate for, to install, to replace (of the
dAitial or any other size), to maintain and use such easement as City
shall from time-to-time elect for utility purposes over and across the
hereinafter described strip of lands which are situate in the County of
'Sonoma, State of California particularly described as follows:

An easement for the construction and'maintenance, of a Sanitary Sewer line,
lying in, along, over,. under'and through a,portion of that certain real
property situated in the City of Petaluma, Sonoma County, California, said
easement being a strip of land feet in width described as follows:
Beginning at the Westerly :terminus of the course ,that bears South 77° 49' 52'"
West 249.00 feet from a point in the. Westerly right-of-way line.,of Main Street,
said course being delineated as South 77° 25' West as described in Parcel One
of that certain deed "Excepting and reserving unto The State of California",
an easement for sanitrary.seWerne PurPoses;saiddeed being recorded in
'Book 2484 of Official Records at Page Sonoma Cotnty. Records; thence North
28°20' 55" West 148.70 feet to,a point in the Southerly line of aforementioned
sanitary sewer easement; thence alOng said 'Southerly line North 83° 08' 53"

courses with such structures as City shall from time -to- time elect;
(c) the right of'.ingress to and egress from said strip over and

is or shall be subdivided and dedicated roads or' highway on such portion
shall extend to said strip, said right of ingress and egress on said
portion shall be confined'.to. such dedicated -roads and highways;
(d) the right ,from tune - to -time 'to trim, and "to cut down and
clear away any and all trees and brush now or . "hereafter on said strip
• and to trim and to cut down and-clear away "any trees on either side of
said strip which now or hereafter the opinion o:f City - may - be a
hazard to said utility as installed, lines, "valves, appliances, or
fittings, by reason of the danger of falling thereon, or may inter-
fere with the exercise of .City's rights here,uhder;. Provided, however,
that all trees which City is. hereby authorized to cut and remove, if
valuable for timber or wood, shall continue to be thee. property of
Owner, but all tops, lops, brush and refuse woodshall be burned or
removed by City;
(e) the right. to instali, maintain and use gates in all fences
which now cross or shall her=ea'fter cross said strip;
(f) the right to mark the location of said strip by suitable •
.markers set in the ground; provided that said ;markers shall be placed in
fences or other locations which will not interfere with any 'reasonable
use Owner shall make of said strap;,
.City, hereby, covenants and agrees:
(a) City shall not fence said strip.; •
(b j' City shall, promptly backfili any trench made by it on
said strip and repair any damage it shall do to - Owner- private roads
or lanes on, said lands; _
(c) ,City shall. indemnify Owner against any loss and damage
which shall, be caused by the exercise of said ingress and egress
