MALPRACTICE INSURANCE

WHEREAS . during -th:eHlast several months nearly every county in
California has experien'.ceda drastic reduction jn `health are services re-
sulting from dramatic increases; in malpractice insurance rates and.,
WHEREAS, .it .i,s ,now_;essential for 'the "state legislature to take
. a role in resolving this problem, by creative Tegi action;
NOW, THEREFORE, BE IT .RESOLVED that: this Council urges the passage
of legislation which would. ,accomplish the =. following: .
1. Reorganize and`" strengthen •the State ;Board of Medical Examin-
ers for more stringent disciplinary powers to deal with
careless and. iincompetent physicians.
2'. Establish voluntary ,contractual. binding arbitration of
patient - doctor disputes wi,,th cla;i -ms and suits settled
- under the jur ,s•diction Of a gtialiafied arbitration panel
governed by the regulations of the;Amer--ican Arbritra-
• tion Assoc- iati,on.
3:. Regulate attorney "s contingency fees to provide fair
temun'eratio0. on <a sli -ding -scale rather than leaving' the
fee bargaining pro:ee 'b,etween , the attorney and his
client,°.
4.. Regulate the method of paymen o.f; awards' to eliminate
duplic_atign ,an to phase distribution according to the
• patients' ne'eds rather than "payment_ o,f a .lump sum award
