HomeMy WebLinkAboutStaff Report 11/07/2011 3.B .8. to n/ #3 o (� a DATE: November 7, 2011 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Remleh Scherzinger, P.E. = Interim Director, Water Resources & Conservati SUBJECT: Resolution Accepting Completion of the Ellis Creek Water Recycling Facility Site Access Improvements Project RECOMMENDATION It is recommended that the City Council adopt the attached Resolution accepting completion of the Ellis Creek Water Recycling Facility Site Access Improvements Project. BACKGROUND The project included installing an 18 -inch thick gravel surface and gate to be used as an emergency access to Lakeville , a gate at entrance to amphitheater trail to prevent unauthorized Lakev vehicles from Highway entering the trail , and a reinforced the concrete slab at the sludge trailer parking area to support heavy trailer loads. These improvements will improve maintenance operations and address emergency access to the site. Bids were opened in March 2011. . On May 16, 2011, the City Council awarded the construction contract to Benchmark Civil Construction of Napa, CA, in the amount of $28,979.00. Construction was successfully completed on September 20, 2011. DISCUSSION Following the`acceptance,of the project, the City Clerk will file a Notice of Completion with the Sonoma County Recorder and the. Finance Division will release the retention money to the contractor °within 60 days. Retention for the project totals $2,815.50. FINANCIAL IMPACTS The Ellis Creek Water Recycling Facility Site Access Improvements, City Project Number C6640 1107, was approved .. in the Ellis Creek Water Recycling Capital Funds with a budget of $62,979. The final construction contract cost is $28,155.00. The final contract amount is less than the awarded contract amount because the units for the rock and fabric were less than bid schedule estimated. Project costs also included construction management performed by Public Agenda Review: City Attorney Finance Director City Manager 1 Works staff at a cost of approximately $4,000 and consulting services for geotechnical and materials testing with Miller Pacific, Inc. at a cost of $2,797.20. Project design was done in- house by Water Resources and Conservation staff; design costs are captured in the CIP administration budget. Total project cost to date is approximately $34,952.20. The remaining account balance is $28,026.80. At project closeout, all remaining funds will return to the Capital Fund to be used on future projects. ATTACHMENTS 1. Resolution 2. Location Map 2 RESOLUTION ACCEPTING COMPLETION OF THE ELLIS CREEK WATER: RECYCLING FACILITY SITE ACCESS IMPROVEMENTS PROJECT WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable laws, the City of Petaluma solicited bids for the Ellis Creek Water Recycling Facility Site Access Improvements Project ( "Project "); and WHEREAS, bids for the Project were opened on March 30, 2011 in accordance with California Public Contract Code Section 4104.5 and other applicable laws; and WHEREAS, the apparent low bid for the Project was the bid of Benchmark Civil Construction (Benchmark) in the amount of $28,979; and WHEREAS, by Resolution No. 2011 -073 N.C.S. adopted 16, 2011, the City Council of the City of Petaluma found the bid of $28,979 for the Project to be the lowest responsive bid and awarded the Project to Benchmark in the, amount of $28,979 conditioned on Benchmark's timely executing the Project contract and submitting all required documents and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any amendments to the Project contract that are necessary to effectively complete the project and /or to realize the Project and /or cost benefits for the City; and WHEREAS, the final contract amount as amended is $28,155; and WHEREAS, City staff has inspected the Project and°determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council •of'the City of Petaluma: , as follows: 1. The contract entitled Ellis Creek Water Recycling Facility Site Access. Improvements, City Project Number C66401107 with a final contract amount of $28,155, is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The. City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3 3. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance'with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law. 4 Attachment 2 Ellis Creek Water Recycl Facility Site Access Improvements PROJECT NO.
