City Engineer 03 SUBJECT: Resolution Approving the Final Map for the East Washington Place. Project Located at 980 East Washington Street • RECOMMENDATION: It is recommended that the City Council adopt the attached resolution, approving the final map., for the East Washington Place Project located at 980 East Washington Street. BACKGROUND: The East, Washington Place Project is a 378,000 square; foot retail and office development including a 6 -lot subdivision located' on a 33.74 -acre parcel at 980 East Washington Street, the site of the former Kenilworth Junior High School. The developer is Regency Centers, LLC. On February 8, 2010, the City Council adopted Resolution 2010- 021C, approving the vesting tentative map for the project. The applicant., submitted the final map and,off- -site improvement plan applications in. July .of 2011. In September of 2011, the City Council approved modifications to the on -site plans. The final map has been revised to reflect these changes. Regency has started construction to relocate the Carter Field little league fields to the site of the Petaluma Junior High School. Construction of the fields is on track to he complete prior to February 2012, the start of the spring little league season. Additionally, Regency has designed the off -site improvement plans to provide for access 'and otherr improvements to the Petaluma Swim Center as well as the Petaluma School District Bus Facility at the southerly end of Lindberg Lane, in accordance with prior agreements. DISCUSSION: Regency is requesting final map approval for ihe,project;so the final map can be filed at the Recorder's Office prior to the end of calendar year 2011. The project is scheduled to start construction as early as January 2012, weather permitting: The off -site and on -site improvement plans are currently in the final plan check review by City staff, including final review by the Sonoma County Water Agency and Caltrans. No construction will be allowed to occur until the Agenda . City"Attorney Finance Director City Manager , appropriate construction level approvals have been secured from outside agencies and permits have been issued by the City for grading, site work, utilities and structures. The applicant has submitted an application` for amaster' sign program which includes building, project entrance and wayfinding signage. The master signage program is subject to the Site Plan and Architectural Review (SPAR) process, and will be scheduled for Planning Commission consideration in either later 2011 or early 2012. All required on -site signage will be installed prior to issuance of certificates of occupancy for respective buildings. All required off -site wayfinding signage will be required to be installed prior to acceptance of public improvements. The final map has been designed to comply with all conditions of approval set forth in the • vesting tentative map approval resolution and other project related legislation as well as all pertinent City standards and policies. Section 66458(a) of the State Subdivision Map Act states that the City Council shall approve a final map if it conforms to all the requirements of the map act and the local subdivision ordinance applicable at the time of approval or conditional approval of the tentative map and any rulings made thereunder. If the final map does not conform, the City Council shall disapprove the map. FINANCIAL IMPACTS: The developer has deposited a total of $1.1,231.16 in final map review fees, which cover the cost of City staff, legal and contract land surveyors. As of October 27, 2011, $6,352.66 has been used. Any remaining funds will be returned to the applicant upon completion of the project. ATTACHMENTS 1. Resolution 2. Vicinity Map 2 ATTACHMENT 1 'RESOLUTION APPROVING THE FINAL MAP FOR THE EAST WASHINGTON PLACE PROJECT LOCATED AT 980 EAST WASHINGTON STREET WHEREAS, the Planning Director and the City Engineer have reviewed the final map of the. East Washington Place Project and have reported that it conforms to Government Code Division 2, Chapter 3, and the City of Petaluma Subdivision Ordinance and is in substantial compliance with the vesting tentative map approved by Resolution No. 2010-021C N.C.S., and; WHEREAS, the reports of the Planning Director and the City Engineer have been forwarded to and reviewed by the City Council; and WHEREAS, the certifications required by law have been endorsed on said map. • NOW, THEREFORE, BE IT RESOLVED that: 1. The City Council finds that the final map conforms to Government Code Division 2, Chapter 3, and the requirements of the City of Petaluma Subdivision Ordinance and is in substantial compliance with the vesting tentative map previously approved for the East Washington Place Project by Resolution No. 2010-021C N.C.S., the findings of which are hereby incorporated by this reference as if fully set forth herein. 2. The final map of the East Washington Place Project is hereby approved, conditioned upon the performance of all conditions set forth in Resolution No. 2010-021C N.C.S., incorporated herein by reference. 3. Upon execution of the Subdivision Public Improvements Agreement in a form approved by the City Attorney and the furnishing of the required improvement security and insurance, approved as to form by the City Attorney and as to sufficiency by the City Manager, the City Clerk is hereby authorized and directed 3 to sign the certificate on said final map certifying that the City Council has approved the same and accepted all streets and other dedications thereon. The City Clerk shall, thereupon cause said final map to be recorded in the Office of the Sonoma County Recorder. 4 ATT ACHMEN 2 I: I f; i !
