HomeMy WebLinkAboutResolution 91-355 12/02/19911 2 3 4 5 6 7 8 9 10 11 12 resolution No. ~~~ N.C.S. of the City of Petaluma, California A RESOLUTION APPROVING THE ISSUANCE OF A MITIGATED NEGATIVE DECLARATION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR A GENERAL PLAN LAND USE DESIGNATION AMENDMENT AND A REZONING FOR AP NO.'s 007-104-01, 03 AND 04 (PEP/PAYRAN) WHEREAS, the Planning Commission has recommended the issuance of a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for the following project: 13 1. Amendment to the General Plan Land Use Designation from "Light Industrial" to 14 "Mixed Use" fora 6 acre site located at the corner of Payran, Vallejo and Jefferson 15 Streets, Sonoma County Assessor's Parcel No.'s 007-104-01, 03 and 04. 16 17 2. Amend the Petaluma Zoning Ordinance to institute a Planned Unit District Zone 18 designation for a portion of the parcel to allow 84 units low-moderate cost housing 19 for senior and/or physically handicapped citizens, and a RC (Compact Residential) 20 Zone for another portion to allow 25 single-family homes. 21 22 WHEREAS, An initial Environmental Noise Study completed by Illingworth and Rodkin, 23 Inc. (August 1991) identified the site's noise environment as being impacted by locating a 24 residential development adjacent to a significant noise source, thereby requiring mitigation; 25 and 26 27 WHEREAS, the developer has included sound mitigation devices into the Development 28 Plan and monitoring of those mitigation efforts will occur during plan review of 29 construction of the project. 30 31 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative 32 Declaration pursuant to the California Environmental Quality Act is hereby approved, 33 based on the following findings: 34 35 1. The project, as mitigated, does not have the potential to degrade the quality of the 36 environment, substantially reduce the habitat of a fish or wildlife species, cause a 37 fish or wildlife population to drop below self-sustaining levels, threaten to eliminate 38 a plant or animal community, reduce the number or restrict the range of a rare or 1 fze5. rv~.....y.1.m35.5........ v.c.s. a03-oa~ 1 endangered plant or animal or eliminate important examples of the major periods 2 of California history or prehistory. 3 4 2. The project, as mitigated, does not have the potential to achieve short-term, to the 5 disadvantage of long-term, environmental goals. 6 7 3. The project, as mitigated, does not have impacts which are individually limited, but 8 cumulatively considerable. 9 10 4.
