A RESOLUTION APPROVING THE ISSUANCE OF A MITIGATED. NEGATIVE
DECLARATION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY
ACT FOR A GENERAL PLAN AMENDMENT TO DESIGNATE THE FORMER
RAILROAD SPUR (APN 005-060-60) AS MIXED USE AND INDUSTRIAL,
REZONE APN 005-060-44 AND A PORTION OF 60 FROM CH/FP-C TO
PCD/FP-C, AND AMEND THE PETALUMA MARINA AND OFFICE PARK
PCD DEVELOPMENT PROGRAM
WHEREAS, the Planning Commission has recommended the issuance of a MITIGATED
Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for
the following actions:
1. General Plan Amendment of APN 005-060-60, to assign a land use designation of
"Mixed Use" and "Industrial" to the previously undesignated railroad spur as shown
on the attached map.
2. Rezoning of APN 005-060-44 and the portion of 005-060-60 adjacent to the marina
site from Commercial Highway/Flood Plain Combining (CH/FP-C) to Planned
Community District/Flood Plain Combining (PCD/FP-C).
3. Amendments to the Petaluma Marina and Office Park PCD Development Program.
NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative
Declaration pursuant to the California Environmental Quality Act is hereby approved,
based on the following finding and subject to the following mitigations:

1. On the basis of the Initial Study, there is no substantial evidence that the project as
mitigated below will have a significant effect on the environment.

I~ydrology:
1. The proposed additional buildings and parking lot areas shall be designed to avoid
filling or otherwise adversely affecting the capacity of the drainage channel to the
satisfaction of the City Engineer, the Sonoma County Water Agency, and possibly
the Army Corps of Engineers. Certification by a registered professional engineer
must demonstrate that any encroachments shall not result in any increase in flood
levels during the occurrence of the base flood discharge.
2. The project sponsor shall comply with all applicable City policies and ordinances
regarding development in Floodplain Combining districts, and other regulations
contained in Zoning Ordinance Article 16 and Municipal Code Chapter 17.30
"Storm Drainage Impact Fees."

1 Water Quality
3. The applicant shall submit a landscaping plan with any development Mans to
improve the banks and provide a buffer zone along the channels in the vicinity of
the 1.3 acre triangular shaped parcel (APN 005-060-06), which shall utilize native
riparian and upland species where appropriate, subject to approval by SPARC with
review and comment from the Department'of Fish & Game.
Biological Impacts
4. The development plan shall include the widening of the lower end of the channel on
the portion of APN NO. 005-060-60 to be included in the PCD, as an enhanced
wetlands area, and a mitigation monitoring program, subject to approval by the
Department of Fish and Game prior to construction or grading on the parcel.
Air Quality/TYaffic
5. Cumulative impacts on air quality from the proposed project shall be mitigated by
encouraging the use of alternate forms of transportation in the following ways:
a. Design not already approved buildings and related facilities to emphasize
convenient bicycle access, pedestrian and public transportation subject to
approval by SPARC.
b. Establish a mechanism to ensure pedestrian and bicycle access through the
site to begin a connection between the proposed marshland bicycle route to
the southeast of the site, and a potential Golden Gate Transit facility at
Highway 101 and Lakeville prior to the issuance of building permits for any
new buildings. MOPA shall redesign the proposed bicycle circulation to
reduce the potential conflict between automobiles, bicycles, and pedestrians
prior to approval of building permits for any new buildings.
c. Amend PCD Program to permit bus access through the parking lot in order
to facilitate future service to the marina site.
6. Aside from the traffic mitigations suggested here the project shall comply with the
traffic mitigations measures presented in response to the 1986 EIR study of
vehicular emissions prepared for the original Petaluma Marina and Office Complex
project by Wagstaff and Brady.
7. MOPA shall pay traffic mitigation fees for the additional buildings at the time of
certificate of occupancy of the building.
Miscellaneous
8. Construction period emissions shall be mitigated through the mitigation measures
contained in the 1986 EIR, repared for the original Petaluma Marina and Office
Complex project by Wagstaffpand Brady.
9. A geotechnical report shall be submitted with the site improvement plan building
permits to reflect site specific subsurface conditions, particularly the nature of
railroad fill and thickness and consolidation characteristics of the native bay mud.
10. Lighting and buildings shall be designed so as to avoid direct glare into motorists
eyes subject to approval by Site Plan and Architectural Review Committee.

11. The new buildings shall be included in the Marina's security program subject to
approval by the City Police Department.
12. Any subsequent development of the site shall be subject to approval by the City's
Site Plan and Architectural Review Committee (SPARC).
13. The bank improvement plan along the northwestern most channel shall include a
pathway that connects with the existing linear park.
