HomeMy WebLinkAboutResolution 91-351 12/02/1991i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 FZesoluti®Cl No. 91-351 N C.S. of the City of Petaluma, California A RESOLUTION CONDITIONALLY APPROVING THE PUD UNIT DEVELOPMENT PLAN FOR THE SOUTHPOINT BUSINESS PARK (AP NOS.048-080-21, 30, 31, 32; 007-401-11, 12, 14, 15, 16, 27, 31, 34, 35, 36, 38, 39, 40, 41, AND 42) WHEREAS, the project site was rezoned to Planned Unit Development/Flood Plain Combining (PUD/FP-C) by Ordinance No. 1875; and WHEREAS, by action taken on October 29, 1991, the Planning Commission considered and forwarded a recommendation to the City Council to conditionally approve the PUD Unit Development Plan for SouthPoint Business Park; and WHEREAS, the City Council finds that the requirements of the California Environmental Quality Act have been satisfied through the preparation of an Initial Study and the adoption of a Mitigated Negative Declaration by Resolution No.91-345. NOW THEREFORE BE IT RESOLVED that the City Council hereby conditionally approves the Unit Development Plan for the Southpoint Business Park pursuant to Section 19A-504 of Zoning Ordinance 1072 N.C.S., as amended based on the following findings and subject to the following conditions: Findm~s 1. The proposed PUD will result in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of zoning districts by permitting necessary accessory commercial uses in close proximity to the industrial park uses. 2. The circulation pattern and traffic impacts of the proposed Planned Unit Development have been reviewed by the City Traffic Engineer who has determined that the project will have no impact on the level of service at adjacent thoroughfares and that said thoroughfares are adequate to carry additional traffic generated by the development. 3. The plan for the proposed development, as conditioned, presents a unified and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent properties. 4. The approved Design Guidelines limit building coverage to 50%, and require 20' or 25' landscaped setbacks along the streets. A master landscape plan has been approved for the site. Through these established standards, the scemc qualities of the site, will be protected and adequate open spaces will be provided. 1 Res. N~........91-351...... c.c.s. a~~-b a. 5. The development is in general conformity with the General Plan Land Use, Community Health and Safety and Community Character Chapters. 6. Public necessity, convenience, and general welfare clearly permit the adoption of the proposed amendment by permitting a more viable and efficient mix of uses for the business park. Conditions: 1. The master plan for the Southpoint Business Park shall be put into the form of PUD standards and shall be amended to include the permitted uses, including the requirement that no more that 20% of the floor area be devoted to retail and/or office uses, based on the projected maximum build-out of 347,000 square feet subject to approval by Planning staff. 2. The PUD Standards shall be modified to include No.'s 9, 10 and 11 as conditionally permitted uses subject to a minor use permit. 3. Uses numbers 9 and 11 in the PUD Standards shall be modified to indicate that these uses shall only be permitted as uses incidental to the industrial park. 4. Changes in use shall be reviewed by staff for compliance with the Parking Standards. 5. Any exceptions to the Southpoint Business Park design guidelines shall be subject to approval by Site Plan and Architectural Review Committee. sppudres/dd1/12/24/91 Under the power and authority conferred upon this Council by the Charter of said City.
