HomeMy WebLinkAboutResolution 91-345 11/18/1991R~SOlutlon N®. 91-345 N ~.5. 1 of the City of Petaluma, California 2 3 4 A RESOLUTION APPROVING THE ISSUANCE OF A MITIGATED NEGATIVE 5 DECLARATION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY 6 ACT FOR THE REZONING FROM ML/FP-C TO PUD/FP-C AND THE ADOPTION 7 OF PUD GUIDELINES FOR THE SOUTHPOINT BUSINESS PARK 8 (AP NOS.048-080-21, 30, 31, 32; 007-401-11, 12, 14, 15, 16, 27, 31, 34, 35, 36, 38, 39, 40, 41, 9 AND 42) 10 11 12 WHEREAS, the Planning Commission has recommended the issuance of a Mitigated 13 Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for 14 an amendment to Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying and 15 rezoning certain lands being more particularly described as Assessors Parcel Numbers 048- 16 080-21, 30, 31, 32; 007-401-11, 12, 14, 15, 16, 27, 31, 34, 35, 36, 38, 39, 40, 41, and 42 from 17 Light Industrial-Flood Plain Combining (ML/FP-C) to Planned Unit Development-Flood 18 Plain Combining (PUD/FP-C) and the adoption of Planned Unit Development standards. 19 20 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative 21 Declaration pursuant to the California Environmental Act is hereby approved, based on 22 the following findings and subject to the following mitigations: 23 24 Findings• 25 26 1. On the basis of the Initial Study there is no substantial evidence that the project as 27 mitigated will have a significant effect on the environment. 28 29 2. The Initial Study has evaluated the potential for this project to cause and adverse 30 effect -- either individually or cumulatively -- on wildlife resources. for this purpose, 31 wildlife is defined as "all wild animals birds, plants, fish, amphibians, and related 32 ecological communities, including habitat upon which the wildlife depends for its 33 continued viability. "(Section 711.2, Fish and Game Code). There is no evidence 34 that the proposed project would have any potential for adverse effect on wildlife 35 resources. 36 37 Miti atg ions: 38 39 1. Any new lights shall be directed away from Highway 101. Lighted signs shall be oriented away from Highway 101. 3. Development shall generally follow the mix of uses proposed by the applicant: 80% of floor area for light industrial uses and 20% retail/office uses. If the applicant wishes to change this mix of uses to include more retail/office uses, or to increase the total floor area at build-out beyond 347,000 square feet, an amendment to the PUD and a General Plan Land Use amendment will be necessary. 4. Traffic mitigation fees will be required prior to the issuance of a certificate of occupancy. Each developer/applicant shall be responsible for the additional fees required upon any change in use of an approved industrial space to office or commercial use. spndres/dd1 Under the power and authority conferred upon this Council by the Charter of said City.
