HomeMy WebLinkAboutResolution 91-319 11/04/1991~es®IlltlOn No. 91-319 N.~.S. of the City of Petaluma, California RESOLUTION ACCEPTING PROPOSAL FOR SPECIAL ASSESSMENT PROCEEDINGS FOR REDWOOD BUSINESS PARK III ASSESSMENT DISTRICT The City Council of the City of Petaluma resolves: G & W Redwood Associates, Joint Ventures (the Developers) is to undertake the construction of the following described public improvements: The construction of public improvements, including streets, curbs, gutters and sidewalks, utilities, storm drainage, street signage and markings, bridges and all other appurtenances required as a condition of the approval of the tentative map for Redwood Business Park III. The Developer proposes to this City Council that the City include in the proposed Redwood Business Park III Assessment District the acquisition of these public improvements, the cost of the acquisition to be assessed on the property of the developer benefiting from the improvements. The City Council accepts this proposal in principle, subject to the following conditions: 1. The special assessment proceedings shall be taken under the Municipal Improvement Act of 1913, with improvement bonds to be issued under the Improvement Bond Act of 1915. 2. The described improvements or portions of them shall be certified by the City Engineer as complete and in place before payment is approved. The improvements may be acquired notwithstanding that the right-of-way may have earlier been dedicated to the City as a part of the Res. No......9.1.-.3.1.9........ N.C.S. ~.,r' ~ ~o ~ 41 1 d~ process of filing a final map of the developer's subdivision. 3. The developer shall submit evidence satisfactory to the City Engineer that the costs to be reimbursed shall have been actually incurred and paid, and that the land assessed shall be free of mechanics' liens resulting from the construction of the improvements. This resolution shall in no way constitute a guarantee or assurance that the special assessment proceedings will be completed, the City Council being without jurisdiction to assure the levy of special assessments until conducting a public hearing as required by the Municipal Improvement Act of 1913. Under the power and authority conferred upon this Council by the Charter of said City.
