2 RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
3 INTO A MEMORANDUM OF UNDERSTANDING WITH THE COMMITTEE
4 ON THE SHELTERLESS (COTS) TO OPERATE THE ARMORY COLD
5 WEATHER SHELTER FOR 1991-92

7 WHEREAS the City of Petaluma wishes to assist in the provision of warm, safe, and
8 decent shelter for homeless adults during the cold weather months; and
9
10 WHEREAS the National Guard Armory (or a reasonable alternative) is the most efficient
11 facility for such temporary shelter; and
12
13 WHEREAS COTS has the expertise and experience to operate such a winter shelter
14 program;
15
16 THEREFORE BE IT RESOLVED THAT the City Manager is authorized to enter into a
17 Memorandum of Understanding with COTS to operate the Armory Shelter Program for
18 the length of time that the Governor authorizes the National Guard Armory for such
19 purpose.

MEMORANDUM OF UNDERSTANDING

r-OMMUNiTY DEVELOPMENT
This Memorandum of Understanding (MOU)' is made between the City of Petaluma and
the Committee On The Shelterless (COTS) for the purposes of defining the understanding
between the City and COTS concerning the operation of the cold weather program for
homeless adults for the winter of 1991-92.
I. BASIC PROVISIONS
1.1 Term of the MOU and Service Agreement. The term of ,this MOU shall commence
on the date that use of the National Guard Armory as shelter is approved by the
Governor and shall terminate on the date that such approval is discontinued. The.
anticipated dates of the service are from mid -November, 1991 to mid -March, 1992.
1.2 Responsibilities of each Partv.
The City of Petaluma:

_f the Cold-
Weather -Shelter at the National- Guard Armory. (City Council
Resolution 91-130)
b. Will sign the monthly license with the Petaluma National Guard.
C. Will perform or contract for routine maintenance as necessitated from
time to time.
d. Assist COTS with -locating a substitute facility --for those weekends
when the°National Guard uses the Armory.

Will operate the National. Guard. Armory/Shelter program for
homeless adults in a safe, decent and sanitary manner.
Wi11- submit- monthly invoices for. wages,- services and supplies
necessary to operate the Shelter in a safe and decent manner. (See
proposed budget, Exhibit A.)
Maintain records of costs and client use for City Council review.

II. ALTERNATIVE PROVISIONS
L2 As of the writing of this MOU, there are still several unknowns. Therefore, the
following alternative provisions will be in effect:
1.2a Should the Governor not approve the use of, the National Guard Armory for
shelter .purposes, City staff and COTS shall make every effort to locate
another facility and operate a similar program, or
1.2b Should the weather be such that the Governor approve the continuance of
the homeless program for an extended period after the expected termination
date of, mid -March, COTS, will invoice the City on a pro -rated, per -diem basis
for repayment.
1.2c Should either ,party, fail to fulfill its portion of the agreement, then the terms
of the agreement and the funding allocation are no longer valid.
