Regular Meeting of the City Council of the
City of Petaluma, on the 16th day of June , 1975
WHEREAS, the matter of the appeal of Robert F Carmody from the decision of
the Planning Commission renUiring an Environmental impact Report for the "D" Street
Plaa came on regularly before this Council on May 19, 1975; and,
- WHEREAS, oral testiMonY and written documents were presented by Robert F.
Carmody and by City staff; and,
WHEREAS, at the close, .of the hearing on-May 19i 1975, this Council was unable .
to reach,a,decisionand ordered that the matter be taken, under submission until Council
man Perty,, who was not inattendance, could' be Presentl and)
WHEREAS, at the 'tiMe..Of hearing, both City staff and Robert F. Carmody agreed • .
, that at such time as Councilman Perry could review the tapes, of the hearing held on May
19, 1975, and the written evidence submitted thereat 'the matter, would come on again
before the Council for decision; and, '

WHEREAS, at the meeting of June 16, 1975, . Councilman Perry asserted that he
had listened to the tape of the hearing held on May 19, 1975, and read all of the doc-
uments and evidence submitted at that time; and,
- ,WHEREAS, •at the meeting of June 16, 1935, the following nuestion was submitted
for the Council's decision, "Shall the decision of the Planning Commission requiring the
preparation of an Environmental Impact Report be sustained?"

NOW THEREFORE, BE IT RESOLVED that this Council -finds and determines, as
follows: .
1. 'The decision of the Planning COMMisSion requiting the preparation of an
Environmental Impact Report 'shall be sustained
. .
2. The subject project will haVea"significant effect upon the environment in
that: .
a. The subject project will have impacts which , have the potential to
degrade' the quality of the environment,
b. The subject project will have impact on two or more separate re -'1
sdutces,' the total of which,constitute a signifiCant impact on the eiWironment,
c. The subject project will have substantial and demonstrable negative
aesthetic effects.

, 3. This Council hereby finds the following facts:

a. Subject project will increase, or Is likely to increase, traffic

volume and traffic congestion in and around the intersection of "D" Street and Petaluma
Boulevard South.

- b +. The sale of off. -sale liquors at the subject property will increase,
or is likely to increase, in, a subsitantial'way the. need for public services at Walnut
Park including police , and park maintenance.
c. The sale of off-sale liquors on the property may cause an
increased and different use of the adj'acentWalnut Park with the potential of altering
.its present residential, low - intensity character.
d. The ,typical 7/11 Food Store architecture and signing will have the
potential of altering the character of the neighborhood and future development in the
area.
