ARTICLE 'i
RECOGNITION
DESCRIPTION OF UNIT
1, For the purposes' of meeting and conferring with respect to
wages, hours, and conditions of employment -, the City to the
extent .permitted by law, recognizes the, Union as the repre-
sentative for all employees who are 'employed in and assigned
to the job classifications which in the aggregate constitute
the City's work UnitNumber Two ,(2) .(Maintenance).

DEFINITIONS
6. 6. "Calendar work week" means any consecutive 168-hour period.
7. "Normal work week" means any five (5) consecutive calendar
days within a calendar- work week.
8. "Senority" means uninterrupted employment with the City
beginning with the last date hired by the City and shall
include periods of City employment outside the Unit, but
shall exclude periods of layoff and leaves of absence,
except medical, in e of 30 consecutive days, including
the first .30 days of such absence.

ARTI CLE 3
UNION SECURITY
1. It is the intent of this Article t� provide for the regular
dues of union members to be deducted from their warrants
insofar as permitted by law. The City agrees to deduct and
transmit to the Union,dues from all Union; members within the
foregoing unit who has signed an authorization card for such
deductions in a form agr.eed upon by the City and the Union.
However, the City. assumes responsibility either to the
employee or to the .Union, for any failure to make or for any
errors . made in making such deductions.

• ARTICLE 4 ' •
DUES CHECKOFF'
1. During the life of this Agreement', and to the extent the •laws
of the State of California permit, and as provided in this
Article,' the City will deduct one month current and periodic
Union dues based 'upon a uniform dues schedule from the pay of
each employee who -Voluntarily executes' aild delivers to the City
the following authorization form:

6. Payroll deductions shall be made in equal amounts from each
regular pay check:provided, however, the initial deduction
for employees shall not begin unless:
1. A properly executed "Voluntary Authorization For
Deduction 0I-Union Dues" is on file with the City,
and,
2. The amount of the monthly membership dues certified
by the Secretary- Treasurer .of the Union has been
delivered to the City at a place designated by the
City at least ten (10) calendar days prior to the
last day of; the pay period.
9. All sums deducted by the City shall be ; r - emitted to the Secre-
tary-Treasurer of the Union at an address given to the City
by the Union, by the tenth (loth) calendar day following the
pay period when the deductions were made, together with a list
of names and, the amount deducted for each employee for whom a
deduction was made. The City will also notify the Union of
the name of each employee who revokes his "Voluntary Author-
ization For Deduction Of Union Dues ". = ...

UNION RIGHTS`.'
4. Upon the request of the aggrieved employee', a •Steward or Union
Officer may inVestigate the specified grievance, provided it
is in his assigned work area, and assist in its presentation.
A reasonable amount, of paid time shall be afforded the Steward
or Union Officer investigating such :grievance . In pre-
senting such gr:ievance,toathe City the Steward or Union Officer
shall be allowed reasonable time off during regular working
hours without loss' Of pay, subject to prior notification of
his immediate Supervisor and with the concurr-ance of the City
Manager.
5. Upon request to the City Manager, aPrepresentative of Laborers'
Union, Local 139 who will be representing the employee in the
ievance rocedure,
g p -may visit work areas. at a time mutually
agreeable to both.parties for the purpose of preparing the case.
Such visitation rights shall be limited to a reasonable amount
of time and shall not interfere with, normal work- operations.
8. In the event a dispute arises concerning the appropriateness
and /,or amount of material posted, the Steward of the Union will
be advised by the City Manager of'the nature of the dispute and
the disputed material will be removed from the bulletin boards
until the dispute is resorlved.
ARTICLE 6
GENERAL PROVISIONS
SPECIAL CONFERENCES•
5. At the request of either the Union or the City, conferences
shall be held for the purpose of considering matters of mutual
interest, other than g- rievaices under consideration in the
grievance proceudre,:provided that mutually acceptable arrange-
ments as to time and place can be made. All such conferences
shall be arranged through the Steward of the Union, or his des -
ignated•respr-esentative, and a designated representative of the
City Manager. Representatives of the Union, not to exceed two
(2), shall not suffer loss of time or pay when absent from their
normal schedule of work for the pupose_of attending a conference.
Conferences may be attended by representatives of Laborers'
Union, Local 139 Benefit plan review and proper classification
assignment will be appropriate subjects for conferences.

MEAL AND_REST PERI " ODS
1. All employees shall be granted a meal period of thirty (30)
minutes, during each scheduled work shift; except for employees
who work other than the regular day shift. The designated
thirty (30) minute-meal period shall .be 'without pay. However,
if an employee is required to work more than five (5) consec-
utive hours without a meal period during a regular work shift
the employee shall be paid at the rate of time and one -half (12)
for all time worked in excess of five (5) hours until such
time as the.. employee. receives a meal period.
2. The City shall reimburse for the reasonable cost of a meal for
any employee who is ;requested and who does work two (2) hours
beyond the employee's, normal quitting time and has been pre-
vented from eating a meal after such quitting time.
3. There shall be granted a rest period at a time, place and
manner that does not interfere with the efficient operation
of the Department. Such rest period shall be with pay and
shall not exceed fi :teen; (15) minutes. for each four (4) hours
of work. The rest period is intended to be a recess to be
preceded and followed by an extended work period. Consequently,
it may not be used to cover an employee's late arrival to work
or early departure, to extend the meal period, nor may it be
regarded as cumulative if not taken.

set forth in this agreement in Appendix A.

mean time which an employee must be awail on a call basis

2. A, minimum compensation of $,35.00 pay :for- each weekend stand - by

SENIORITY
STATEMENT OF PRINCIPLES OF SENIORITY
1. In the event of any reduction in the work force, the City will
apply the principle'o merit and ability being equal,
and the last employee hired shall be the first laid off. In
rehiring, the last person laid off shall be the first rehired.
A complaint regarding compliance with this section shall be a
subject for grievance. In rehiring former employees laid off
under this Article, the City shall offer reemployment in the
order of seniority to such former employees who at the time of
lay off were performing services essentially the same as required
for the vacancy, provided that the period of lay off has not
exceeded one (l)- yea : r.
SENIORITY LIST
4. The City shall prepare and maintain a seniority list which shall
show the names, clarification title, department and seniority
date of all employees. The Union (Laborers' Union, Local 1,39)
shall be given two copies of the list within thirty (30) calen-
dar days after the date of this Agreement, and thereafter a
current list every six months.

4 An employee who is elected o r appointed to office or who is
selected for regular employment with the Union (Laborers'
Union, Local 139). or the International- Union, upon written
request of the. Secretary- Treasurer of the Union, may be granted
a leave of absence without pay for not more; than three (3)
months. Upon written request of the Secretary of
the Union, the leave maybe extended for additional periods,
but in no case shall a leave and extensions exceed six (6)
months. .

5. An employee who is elected or selected by the Union, upon the
written_ request ` the Secretary - Treasurer of the Union, may
be granted an excused absence without pay for a period not to
exceed five (5) days •per year to attend conferences or con-
ventions. Not more than one employee will be granted an
excused absence at any one time.

UNIT 2
AUTHORIZED., CITY OBSERVED, PAID HOLIDAYS
In 1976 the City will designate ten (19) paid, fixed-date
holidays per employee as listed below. ,Additionallyf during
1975-76 the City will authorize one cly paid floating holiday
per employee, whcch may be taken by the employee at a time
selected by the employee, subject to operational requirements
as determined by department head.
The ten (10) designate 'fixed-date holidays to be observed:
HOLIDAYS - 1976
• 1. New Year's Day January 1
2. Washington's EirthdaY ' 3rd Monday in February
3. Memorial Day , Last Monday in May
4. Independence Day July 4 (to be observed
