2 RESOLUTION AMENDING THE DEVELOPMENT PLAN FOR
3 KINGSMILL SUBDIVISION TO ALLOW CONSTRUCTION OF
4 A CHURCH AND ASSOCIATED SITE IMPROVEMENTS,
5 SONOMA MOUNTAIN PARKWAY AND CASTLE DRIVE,
6 PORTION OF AP NO. 136-120-11

9 WHEREAS, by Ordinance No. 1828 N.C.S., Assessor's Parcel Number 136-120-11 was
10 rezoned to PUD (Planned Unit District); and
11
12 WHEREAS, Condition 6.g. of Resolution No. 90-365 approving the Kingsmill Subdivision
13 Unit Development Plan required a PUD amendment prior to development of the church
14 site; and
15
16 WHEREAS, application was subsequently made by Truman Whorton, on behalf of the
17 Church of Christ, to amend the Kingsmill PUD Development Plan to allow construction of
18 a church and associated site improvements; and
19
20 WHEREAS, by action taken on August 27, 1991, subsequent to a public hearing on this
21 matter, the Planning Commission recommended conditional approval of the proposed
22 amendment in said Planned Unit District; and
23
24 WHEREAS, a Mitigated Negative Declaration prepared pursuant to the California
25 Environmental Quality Act was adopted by the City Council (Resolution No.
26 91-302 N.C.S.) on ~ 0~7~91 , as recommended by the Planning Commission;

28 NOW, THEREFORE, BE IT RESOLVED that the amended unit development plan on
29 file in the Office of Planning (File REZ91006) is hereby approved pursuant to Section 19A-
30 504 of Zoning Ordinance No. 1072 N.C.S. as amended; and

32 BE IT FURTHER RESOLVED that the City Council hereby adopts findings of the
33 Planning Commission as its findings as stated hereinafter:

36 1. The amended development plan, as conditioned, results in a more desirable use of
37 the land, and a better physical environment than would be possible under any single
38 zoning district or combination of zoning districts.

1 2. The amended development plan, as conditioned, presents a unified and organized
2 arrangement of buildings and service facilities which are appropriate in relation to
3 adjacent and nearby properties and associated proposed projects and that adequate
4 landscaping and/or screening is included if necessary to insure compatibility.
5 3. The natural and scenic qualities of the site will be protected through the
6 implementation of tree preservation conditions of approval, and that adequate
7 available public and private spaces are designated on the amended Unit
8 Development Plan.
9 4. The development of the subject property, in the manner proposed by the applicant
10 and conditioned by the City, will not be detrimental to the public welfare, will be in
11 the best interests of the City, and will be in keeping with the general intent and spirit
12 of the zoning regulations of the City of Petaluma and with the Petaluma General
13 Plan.
14 5. The PUD District is proposed on property which has a suitable relationship to one
15 or more thoroughfares (Sonoma Mountain Parkway) to carry any additional traffic
16 generated by the development.

18 BE IT FURTHER RESOLVED, based on the findings set forth above, that the City
19 Council hereby approves the Amendment to the Kingsmill Subdivision Development Plan,
20 subject to conditions set forth below:

22 Conditions:
23 1. Development of the proposed 3.9 acre church site shall be limited to the following
24 uses:
25 a. Principal and accessory uses as shown on the development plan:
26 primary church building
27 social hall
28 two single-family residences
29 b. Conditional uses permitted in the northeast corner of the site: All principal
30 and conditionally permitted uses identified under the R-1 Zoning District.
31 2. Parking shall be provided for each of the proposed uses in conformance with Zoning
32 Ordinance Standards.
33 3. All proposed buildings shall conform to relevant provisions contained in the
34 Corona/Ely Specific Plan, including restrictions on height and setback along the
35 Sonoma Mountain Parkway frontage, architectural quality, location of parking, and
36 designation of the site as a Gateway. Specific Development Standards (i.e., height,

1 setback, lot coverage, etc.) shall not be required. Rather, each building shall be
2 reviewed in context of the surrounding development for architectural and site design
3 compatibility.
4 4. A parcel map shall be recorded prior to issuance of development permits for this
5 site to achieve the following:
6 a. A separate legal parcel shall be created for the church site.
7 b. Right-of-way and public utility easements shall be dedicated as deemed
8 necessary by City staff along the Sonoma Mountain Parkway and Windmill
9 Lane street frontages of the site.
10 c. An agreement providing for cross-access and maintenance of the shared
11 driveway along Sonoma Mountain Parkway shall be executed and recorded
12 by the owners of the church site and the McDowell property located directly
13 to the south, subject to .staff review and approval.
14 d. Parcel B (the narrow strip of land between the church property and Castle
15 Drive) created by Phase I Final. Map for Kingsmill Subdivision shall be
16 merged with the church property.
17 5. Prior to application for SPARC review, a study of the site shall be conducted for
18 archaeological sensitivity/significance. Cost of archaeological study shall be borne
19 by the project proponent, with selection of consultant to staff approval.
20 6. Each phase of this project shall be subject to Site Plan and Architectural Review
21 with emphasis placed on the following issues:
22 a. Proposed architecture for the primary church building shall be modified to
23 offer additional interest warranted by the Gateway status of the site and
24 improved design linkage with the rural elements fostered within the
25 Kingsmill high-amenity area. Consideration should be given to the massing
26 and siting of the large buildings to insure preservation of vistas/corridors to
27 Sonoma Mountains.
28 b. Architecture for all future buildings proposed shall be reviewed for
29 compatibility in context of surrounding development.
30 c. Landscaping shall be provided along street frontages in conformance with
31 the Sonoma Mountain Parkway Master Landscape Plan and the Kingsmill
32 Subdivision Master Landscape Plan.
33 d. A landscape plan for on-site landscape areas shall be developed. Plans shall
34 include provisions for interim landscaping in undeveloped (future phase)
35 areas. Existing trees shall be preserved and incorporated into the plan.

1 e. Noise attenuating features shall be incorporated into construction plans to
2 reduce traffic noise impacts to acceptable levels as determined; by staff for
3 buildings located along Sonoma Mountain Parkway.
4 f. Windmill relocation and preservation in accordance with the Corona/Ely
5 Specific Plan.
6 7. The following requirements of the City Engineer shall be met:
7 a. Excavation permit shall be obtained prior to all work within the public right-
g of-way.
9 b. Positive lot drainage to the public streets shall be provided.
10 c. Minimum 30' driveway width to be provided at street on Castle Drive.
11 8. Property owner shall participate in the Sonoma Mountain Parkway Benefit
12 Assessment District.
13 9. Any outdoor advertising signs shall be submitted for review and approval of SPARC
14 or the Community Development Department. All signs must conform to the Zoning
15 Ordinance and be compatible with the building and surroundings.
16 10. This project shall be subject to imposition of all applicable special development
17 fees.
18 11. Property owner shall enter into an agreement with the City to provide for
19 annexation of this property to the Kingsmill Subdivision landscape Assessment
20 District.
21 12. This project shall be subject to imposition of a. Specific Plan Fee to defray the cost
22 of preparation, adoption, and administration of the Corona/Ely Specific Plan. The
23 fee shall be based on a pro-rata share of benefit costs as determined by the City in
24 accordance with California Government Code Section 65456(a).
